JOINT STATEMENT: Crackdown Against the Independence of Lawyers in Bangladesh Under the Interim Government

France/ Belgium/ Poland/ Egypt/ Thailand/ Kazakhstan/ India; November 5, 2025: The JusticeMakers Bangladesh in France (JMBF), the Council of Bars and Law Societies of Europe (CCBE), the National Bar Council (CNB), the International Observatory of Lawyers at Risk (OIAD), the Arrested Lawyers Initiative, the Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP), the International Association of People’s Lawyers – Monitoring Committee on Attacks on Lawyers, the People’s Vigilance Committee on Human Rights (PVCHR), the Banglar Manabadhikar Suraksha Mancha (MASUM), the 'NEVER AGAIN' Association, the Asia Pacific Refugee Rights Network (APRRN), the Public Association Dignity, the Programme Against Custodial Torture and Impunity (PACTI), the Solidarité Internationale LGBTQI (SIL) and the Families of the Disappeared (FOD) express grave concern over the contineous politically motivated repression against the independence of the legal community in Bangladesh under the current Interim Government.

Lawyers are being systematically targeted solely for performing their professional duties and exercising their political beliefs. The France-based human rights organization, Justicemakers Bangladesh in France (JMBF), has documented 268 verified incidents of persecution affecting 849 lawyers between August 2024 and September 2025 under the current Interim Government. The evidence reveals a coordinated, politically motivated campaign orchestrated by the Interim Government, led by former Nobel Peace Laureate Muhammad Yunus, and its allies, targeting lawyers for their political affiliations, professional responsibilities, and organizational engagements. This campaign has undermined the independence of the legal profession, obstructed justice, and threatened the rule of law.

Patterns of Persecution

According to JMBF’s verified documentation, the crackdown includes multiple overlapping tactics:

1. Fabricated Cases: 200 incidents affecting 721 lawyers, including false charges of murder, attempted murder, sabotage, seditious conspiracy, extortion, and other crimes, used to criminalize and silence legal professionals.
2. Arbitrary Imprisonment: 75 incidents involving 203 victims (including 57 incidents/73 lawyers imprisoned following arrest, and 18 incidents/130 lawyers imprisoned after voluntary surrender before the court).
3. Physical Violence: 26 incidents affecting 51 lawyers, involving assault, intimidation, and harassment.
4. Targeted Killings: 4 lawyers murdered outside custody, intended to instill fear within the legal community.
5. Vandalism: 7 incidents targeting chambers, homes, and offices, disrupting professional and personal lives.
6. Professional Sanctions: 16 cases involving expulsions from bar associations and license cancellations, stripping lawyers of their professional legitimacy.
7. Misrule of Bars: 16 bar committees forcibly occupied, with lawyers affiliated with the Bangladesh Awami League (BAL) systematically barred from contesting 44 district bar association elections through canceled or refused nomination papers.
8. Other Forms of Repression: 30 incidents affecting 50 lawyers, including surveillance, harassment, extortion, smear campaigns, death threats, and threats of fabricated prosecutions.

Politically Targeted Persecution

The repression has been overwhelmingly politically motivated, disproportionately affecting lawyers affiliated with the Bangladesh Awami League (BAL). JMBF documented 236 incidents involving 795 victims, representing 88% of all incidents and 93% of all victims nationwide. These figures demonstrate a deliberate effort to neutralize pro-BAL lawyers and obstruct justice.

Call to Action

We strongly condemn these politically motivated and systematically targeted attacks and call on the Interim Government of Bangladesh to:

1. Immediately end all forms of persecution against lawyers in Bangladesh.
2. Release all imprisoned lawyers and withdraw all charges unconditionally.
3. Ensure protection of lawyers from harassment, intimidation, and violence.
4. Guarantee justice for persecuted lawyers and prevent further persecution.
5. Create an enabling environment for lawyers to perform their duties without fear or interference.
6. Provide adequate physical, psychological, and financial protection and compensation to persecuted lawyers and their families.
7. Launch an independent investigation into all incidents of persecution, with the participation of an international investigative committee, to ensure perpetrators are held accountable.
8. Enact a Protection of Lawyers Act in line with the UN Basic Principles on the Role of Lawyers.

We also urge the international community, including bar associations and human rights organizations, notably the United Nations Human Rights Council, the European Parliament, and the European Commission, to closely monitor the situation and provide support to lawyers under threat in Bangladesh.

We reaffirm our commitment to protecting the independence of lawyers and to upholding justice, human rights, and the rule of law.

BANGLADESH : Répression contre l’indépendance des avocats au Bangladesh sous le gouvernement intérimaire

France/ Belgique/ Pologne/ Égypte/ Thaïlande/ Kazakhstan/ Inde; 5 novembre 2025: Le JusticeMakers Bangladesh en France (JMBF), le Conseil des barreaux et des sociétés de droit d’Europe (CCBE), le Conseil national du barreau (CNB), l’Observatoire international des avocats en danger (OIAD), l’Initiative des avocats arrêtés, le Centre arabe pour l’indépendance de la justice et de la profession juridique (ACIJLP), l’Association internationale des avocats du peuple – Comité de suivi des attaques contre les avocats, le People’s Vigilance Committee on Human Rights (PVCHR), le Banglar Manabadhikar Suraksha Mancha (MASUM), l’association ‘NEVER AGAIN’, le Réseau Asie-Pacifique pour les droits des réfugiés (APRRN), l’Association publique Dignity, le Programme contre la torture et l’impunité en détention (PACTI), la Solidarité Internationale LGBTQI (SIL) et les Familles des Disparus (FOD) expriment leur vive préoccupation face à la répression politique continue portant atteinte à l’indépendance de la communauté juridique au Bangladesh sous le gouvernement intérimaire actuel.

Les avocats sont systématiquement ciblés uniquement pour l’exercice de leurs fonctions professionnelles et de leurs convictions politiques. Les preuves révèlent une campagne coordonnée et politiquement motivée, orchestrée par le gouvernement intérimaire dirigé par l’ancien lauréat du prix Nobel de la paix, Muhammad Yunus, et ses alliés, visant les avocats en raison de leurs affiliations politiques, de leurs responsabilités professionnelles et de leurs engagements associatifs. Cette campagne a compromis l’indépendance de la profession juridique, entravé l’accès à la justice et menacé l’État de droit.

Schémas de persécution

Selon la documentation vérifiée du JMBF, la répression comprend plusieurs tactiques qui se chevauchent :

1. Affaires fabriquées : 200 incidents affectant 721 avocats, incluant de fausses accusations de meurtre, de tentative de meurtre, de sabotage, de complot séditieux, d’extorsion et d’autres crimes, utilisées pour criminaliser et réduire au silence les professionnels du droit.
2. Emprisonnement arbitraire : 75 incidents impliquant 203 victimes (y compris 57 incidents/73 avocats emprisonnés après arrestation, et 18 incidents/130 avocats emprisonnés après se présenter volontairement devant le tribunal).
3. Violence physique : 26 incidents affectant 51 avocats, impliquant agressions, intimidations et harcèlement.
4. Meurtres ciblés : 4 avocats assassinés hors de détention, visant à instiller la peur au sein de la communauté juridique.
5. Vandalisme : 7 incidents ciblant cabinets, domiciles et bureaux, perturbant la vie professionnelle et personnelle.
6. Sanctions professionnelles : 16 affaires impliquant des expulsions des barreaux et l’annulation de licences, privant les avocats de leur légitimité professionnelle.
7. Détournement de barreaux : 16 comités de barreaux occupés de force, les avocats affiliés à la Ligue Awami du Bangladesh (BAL) étant systématiquement empêchés de concourir à 44 élections de barreaux de district par l’annulation ou le refus de leurs candidatures.
8. Autres formes de répression : 30 incidents affectant 50 avocats, incluant surveillance, harcèlement, extorsion, campagnes de diffamation, menaces de mort et menaces de poursuites fabriquées.

Persécution politiquement ciblée

La répression est majoritairement motivée politiquement, affectant de manière disproportionnée les avocats affiliés à la Ligue Awami du Bangladesh (BAL). Le JMBF a documenté 236 incidents impliquant 795 victimes, représentant 88 % de tous les incidents et 93 % de toutes les victimes dans tout le pays. Ces chiffres démontrent un effort délibéré pour neutraliser les avocats pro-BAL et entraver la justice.

Appel à l’action

Nous condamnons fermement ces attaques politiquement motivées et systématiquement ciblées et appelons le gouvernement intérimaire du Bangladesh à :

1. Mettre immédiatement fin à toutes les formes de persécution des avocats au Bangladesh.
2. Libérer tous les avocats emprisonnés et retirer toutes les accusations de manière inconditionnelle.
3. Assurer la protection des avocats contre le harcèlement, l’intimidation et la violence.
4. Garantir la justice pour les avocats persécutés et prévenir toute nouvelle persécution.
5. Créer un environnement propice permettant aux avocats d’exercer leurs fonctions sans peur ni ingérence.
6. Fournir une protection physique, psychologique et financière adéquate ainsi qu’une compensation aux avocats persécutés et à leurs familles.
7. Lancer une enquête indépendante sur tous les incidents de persécution, avec la participation d’un comité d’enquête international, afin de garantir que les auteurs soient tenus responsables.
8. Adopter une Loi sur la Protection des Avocats conformément aux Principes de Base des Nations Unies sur le rôle des avocats.

Nous exhortons également la communauté internationale, y compris les barreaux et organisations de défense des droits humains, notamment le Conseil des droits de l’homme des Nations Unies, le Parlement européen et la Commission européenne, à suivre de près la situation et à apporter un soutien aux avocats menacés au Bangladesh.

Nous réaffirmons notre engagement à protéger l’indépendance des avocats et à défendre la justice, les droits humains et l’état de droit.
