Paris, France | 01 August 2026: JusticeMakers Bangladesh in France (JMBF), a France-based international human rights organisation, expresses deep concern, strong condemnation and protest over the detention of a residential student and an external young man on allegations of homosexuality at Masterda Surya Sen Hall of the University of Dhaka; the examination of their personal mobile phones; their handover to police; and the subsequent permanent expulsion of the student from the residential hall.
According to reports published in various newspapers and information received from JMBF’s own reliable sources, on the morning of 30 July 2026, several students at Surya Sen Hall detained and questioned an external young man and examined his mobile phone. Following allegations that information relating to same-sex conversations and exchanges of messages had been found, the hall administration and the proctorial team handed him and the university student concerned over to Shahbagh Police Station. After obtaining written undertakings from them, the police released both individuals into custody. The university administration subsequently cancelled the student’s hall seat and permanently expelled him.
JMBF firmly believes that publicly humiliating a person, forcibly searching a personal mobile phone, extracting a written undertaking under pressure, or taking disciplinary action without due process on the basis of a person’s sexual orientation, private communications or allegations of consensual private relationships is contrary to the fundamental principles of human dignity, privacy, equality and fair trial.
Article 27 of the Constitution of Bangladesh guarantees equality before the law and equal protection of the law for citizens. Article 31 guarantees every person the protection of the law and the right not to be subjected to any action detrimental to life, liberty, body, reputation or property except in accordance with law. Article 32 protects the right to life and personal liberty, while Article 43 guarantees the right to privacy of the home and communications.
Moreover, Bangladesh is a State Party to the International Covenant on Civil and Political Rights (ICCPR). Article 17 of the Covenant prohibits unlawful or arbitrary interference with privacy, while Article 26 guarantees equal protection of the law without discrimination. Furthermore, the United Nations Human Rights Committee has recognised discrimination based on sexual orientation as falling within the scope of these protections.
Robert Jean Paul Simon, Chief Adviser of JMBF and a renowned French LGBTQ+ rights activist, stated:
“No educational institution can be a place of fear, humiliation and discrimination. Harassing a person, handing them over to the police, or depriving them of their right to education and residence on the basis of their sexual orientation or private communications is inconsistent with the fundamental principles of human dignity, privacy and equality. The University of Dhaka must conduct an impartial investigation into this incident and ensure the safety, privacy and equal rights of all students.”
JMBF clearly states that detaining a person, handing them over to the police, or expelling them from a university residential hall merely because of communication through an online app, private exchanges of messages or their sexual orientation constitutes a clear violation of the Constitution of Bangladesh and universally recognised fundamental human rights.
Even where there is an allegation of a breach of residential hall rules, the university authorities must uphold due process, fairness, proportionality and the right to defend oneself. Before permanently expelling any person on the basis of an allegation, the authorities are obliged to provide written notice of the accusation, disclose relevant evidence, ensure an independent and impartial hearing, and provide an effective opportunity to appeal the decision.
JMBF calls for the immediate adoption of the following measures:
- The decision to permanently expel Student X and cancel his hall seat must be suspended, and an independent, impartial and transparent investigation must be conducted.
- An impartial judicial inquiry must be conducted into allegations of coercion, violations of privacy and abuse of authority in connection with the detention, examination of mobile phones, extraction of written undertakings and handover to police.
- The identities, personal information and communications of the two individuals concerned must be protected, and they must be safeguarded from future harassment, threats, public humiliation or retaliatory actions.
- The University of Dhaka must ensure a non-discriminatory, safe and dignified educational environment for all students, irrespective of sexual orientation and gender identity.
- The university administration must formulate and implement clear policies on human rights, privacy, non-discrimination and fair disciplinary procedures.
- The “Sexual Orientation and Gender Identity-Based Minority Protection Act” must be enacted and implemented without delay to protect minorities based on sexual orientation and gender identity.
JMBF reiterates that universities must be safe spaces for knowledge, free thought, human dignity and equality—not places of fear, humiliation, discrimination and persecution. All attempts to curtail or punish anyone’s rights on the basis of sexual orientation must cease, and the human rights of all persons concerned must be ensured.

On Thursday, 30 July, the hall administration detained a residential student of the University of Dhaka, “X” (pseudonym), and an external young man, “Y” (pseudonym), on allegations of homosexuality at Masterda Surya Sen Hall and handed them over to Shahbagh Police Station.
Shahbagh Police Station authorities later took written undertakings and released Student X into the custody of his departmental student adviser and Y into the custody of a gay rights activist. Subsequently, the university administration permanently expelled Student X from the residential hall.
The accused student is a student of the university’s 2022–23 academic session. The external young man, Y, works at BANBEIS. His permanent address is in Bhanga Upazila, Faridpur, and he currently resides in Malibagh, Dhaka.
On the morning of 30 July, Student X, a resident of Surya Sen Hall, invited Y, whom he knew through an online app, to the hall. Instead of going to the designated Room No. 366, Y mistakenly knocked on the door of Room No. 360. The students staying in that room became suspicious and detained and questioned him.
During the questioning, the students allegedly forcibly examined Y’s mobile phone and identified X. They later found an online app used by same-sex persons for communication on both of their mobile phones, along with information about their mutual communication. The students then informed the hall administration.
Upon receiving the information, the Provost and House Tutors arrived at the scene and took both individuals to the Provost’s office, where X and Y gave written undertakings. The administration later handed them over to law enforcement authorities through the proctorial team.
While preparations were underway to take legal action against them, the university’s Proctor’s Office contacted Shahbagh Police Station. Later, in the presence of the departmental student adviser, relevant teachers and representatives of the university administration, the police released Student X into the custody of his department.
Meanwhile, Y stated in a written undertaking submitted at Shahbagh Police Station that the police brought him to the station because he entered a hall room without informing anyone. He further claimed that, while frightened and under pressure, he had written the earlier undertaking containing the statement that he had entered the hall “for the purpose of engaging in homosexual conduct.”
On the basis of the statement contained in the undertaking, the university administration cancelled the hall seat of the student from the 2022–23 academic session and permanently expelled him from Surya Sen Hall.

প্যারিস, ফ্রান্স | ০১ আগস্ট ২০২৬: ফ্রান্সভিত্তিক আন্তর্জাতিক মানবাধিকার সংস্থা জাস্টিসমেকার্স বাংলাদেশ ইন ফ্রান্স (জেএমবিএফ) ঢাকা বিশ্ববিদ্যালয়ের মাস্টারদা সূর্যসেন হলে ‘সমকামিতার অভিযোগে’ এক আবাসিক শিক্ষার্থী ও একজন বহিরাগত যুবককে আটক, তাঁদের ব্যক্তিগত মোবাইল ফোন পরীক্ষা, পুলিশে হস্তান্তর এবং পরবর্তীতে শিক্ষার্থীকে আবাসিক হল থেকে স্থায়ীভাবে বহিষ্কারের ঘটনায় গভীর উদ্বেগ, তীব্র নিন্দা ও প্রতিবাদ জানাচ্ছে।
বিভিন্ন পত্রিকায় প্রকাশিত সংবাদ এবং জেএমবিএফ-এর নিজস্ব নির্ভরযোগ্য সূত্রে প্রাপ্ত তথ্য অনুযায়ী, ৩০ জুলাই ২০২৬ সকালে সূর্যসেন হলের কয়েকজন শিক্ষার্থী এক বহিরাগত যুবককে আটক করে জিজ্ঞাসাবাদ করেন এবং তাঁর মোবাইল ফোন পরীক্ষা করেন। সমকামিতা-সংক্রান্ত কথোপকথন ও বার্তা আদান-প্রদানের তথ্য পাওয়ার অভিযোগে হল প্রশাসন ও প্রক্টরিয়াল টিম তাঁকে এবং বিশ্ববিদ্যালয়ের ওই শিক্ষার্থীকে শাহবাগ থানা পুলিশের কাছে হস্তান্তর করে। পরবর্তীতে তাঁদের কাছ থেকে মুচলেকা নেওয়ার পর পুলিশ উভয়কে জিম্মায় মুক্তি দেয়। পরে বিশ্ববিদ্যালয় প্রশাসন ওই শিক্ষার্থীর হলের আসন বাতিল করে তাঁকে স্থায়ীভাবে বহিষ্কার করে।
জেএমবিএফ দৃঢ়ভাবে বিশ্বাস করে, কোনো ব্যক্তির যৌন অভিমুখিতা, ব্যক্তিগত যোগাযোগ বা সম্মতিপূর্ণ ব্যক্তিগত সম্পর্কের অভিযোগকে কেন্দ্র করে জনসমক্ষে অপদস্থ করা, জোরপূর্বক ব্যক্তিগত মোবাইল ফোন তল্লাশি করা, চাপের মধ্যে মুচলেকা আদায় করা কিংবা যথাযথ প্রক্রিয়া ছাড়া শাস্তিমূলক ব্যবস্থা নেওয়া মানবমর্যাদা, ব্যক্তিগত গোপনীয়তা, সমতা ও ন্যায্য বিচারের মৌলিক নীতির পরিপন্থী।
বাংলাদেশের সংবিধানের ২৭ অনুচ্ছেদ নাগরিকদের আইনের দৃষ্টিতে সমতা ও আইনের সমান সুরক্ষার নিশ্চয়তা দেয়। ৩১ অনুচ্ছেদে প্রত্যেক ব্যক্তির আইনের সুরক্ষা এবং আইন ব্যতীত জীবন, স্বাধীনতা, দেহ, সুনাম বা সম্পত্তির ক্ষতিসাধন না করার অধিকার নিশ্চিত করা হয়েছে। ৩২ অনুচ্ছেদ জীবন ও ব্যক্তিস্বাধীনতার সুরক্ষা দেয় এবং ৪৩ অনুচ্ছেদ বাসস্থান ও যোগাযোগের গোপনীয়তার অধিকারের নিশ্চয়তা প্রদান করে।
তাছাড়া, বাংলাদেশ আন্তর্জাতিক নাগরিক ও রাজনৈতিক অধিকার সম্পর্কিত সনদে (আইসিসিপিআর) রাষ্ট্রপক্ষ। সনদের ১৭ অনুচ্ছেদ ব্যক্তিগত গোপনীয়তায় বেআইনি বা স্বেচ্ছাচারী হস্তক্ষেপ নিষিদ্ধ করে এবং ২৬ অনুচ্ছেদ বৈষম্য ছাড়া আইনের সমান সুরক্ষা নিশ্চিত করে। অধিকন্তু, জাতিসংঘ মানবাধিকার কমিটি যৌন অভিমুখিতার ভিত্তিতে বৈষম্যকে এই সুরক্ষার আওতাভুক্ত হিসেবে স্বীকৃতি দিয়েছে।
জেএমবিএফ-এর প্রধান উপদেষ্টা এবং প্রখ্যাত ফরাসি এলজিবিটিকিউ+ অধিকারকর্মী রবার্ট জ্যাঁ পল সিমন বলেন:
“কোনো শিক্ষাপ্রতিষ্ঠান ভয়, অপমান ও বৈষম্যের স্থান হতে পারে না। কারও যৌন অভিমুখিতা বা ব্যক্তিগত যোগাযোগকে কেন্দ্র করে তাঁকে হেনস্তা করা, পুলিশে হস্তান্তর করা কিংবা শিক্ষা ও আবাসনের অধিকার থেকে বঞ্চিত করা মানবমর্যাদা, গোপনীয়তা ও সমতার মৌলিক নীতির সঙ্গে অসামঞ্জস্যপূর্ণ। ঢাকা বিশ্ববিদ্যালয়কে অবশ্যই এই ঘটনার নিরপেক্ষ তদন্ত করে সকল শিক্ষার্থীর নিরাপত্তা, গোপনীয়তা এবং সমঅধিকার নিশ্চিত করতে হবে।”
জেএমবিএফ স্পষ্টভাবে ব্যক্ত করছে যে, কোনো অনলাইন অ্যাপে যোগাযোগ, ব্যক্তিগত বার্তা আদান-প্রদান বা কারও যৌন অভিমুখিতার কারণে কাউকে আটক, পুলিশে হস্তান্তর বা বিশ্ববিদ্যালয়ের আবাসিক হল থেকে বহিষ্কার করা বাংলাদেশ সংবিধান ও জাতিসংঘঘোষিত মৌলিক মানবাধিকারের সুস্পষ্ট লঙ্ঘন।
আবাসিক হলের নিয়ম ভঙ্গের কোনো অভিযোগ থাকলেও বিশ্ববিদ্যালয় কর্তৃপক্ষকে আইনি প্রক্রিয়া, ন্যায্যতা, আনুপাতিকতা এবং আত্মপক্ষ সমর্থনের অধিকার মেনে চলতে হবে। অভিযোগের ভিত্তিতে কাউকে স্থায়ীভাবে বহিষ্কারের আগে তাঁকে লিখিত অভিযোগ জানানো, প্রাসঙ্গিক প্রমাণ উপস্থাপন, স্বাধীন ও নিরপেক্ষ শুনানি এবং সিদ্ধান্তের বিরুদ্ধে আপিলের কার্যকর সুযোগ দেওয়ার বাধ্যবাধকতা রয়েছে।
জেএমবিএফ অবিলম্বে নিম্নলিখিত পদক্ষেপ গ্রহণের আহ্বান জানাচ্ছে:
১। শিক্ষার্থী এক্সের স্থায়ী বহিষ্কার ও হলের আসন বাতিলের সিদ্ধান্ত স্থগিত করে একটি স্বাধীন, নিরপেক্ষ ও স্বচ্ছ তদন্ত পরিচালনা করা হোক।২। আটক, মোবাইল ফোন পরীক্ষা, মুচলেকা গ্রহণ এবং পুলিশে হস্তান্তরের ক্ষেত্রে জবরদস্তি, ব্যক্তিগত গোপনীয়তার লঙ্ঘন বা ক্ষমতার অপব্যবহারের বিষয়ে নিরপেক্ষ বিচারবিভাগীয় তদন্ত করা হোক।৩। সংশ্লিষ্ট দুই ব্যক্তির পরিচয়, ব্যক্তিগত তথ্য ও যোগাযোগের গোপনীয়তা সুরক্ষিত রেখে তাঁদের বিরুদ্ধে ভবিষ্যতে হয়রানি, হুমকি, প্রকাশ্য অপমান বা প্রতিশোধমূলক আচরণ থেকে নিরাপত্তা প্রদান করা হোক।৪। ঢাকা বিশ্ববিদ্যালয়কে যৌন অভিমুখিতা ও লিঙ্গপরিচয় নির্বিশেষে সকল শিক্ষার্থীর জন্য বৈষম্যহীন, নিরাপদ ও মর্যাদাপূর্ণ শিক্ষার পরিবেশ নিশ্চিত করতে হবে।৫। বিশ্ববিদ্যালয় প্রশাসনকে মানবাধিকার, ব্যক্তিগত গোপনীয়তা, বৈষম্যবিরোধী নীতি এবং ন্যায্য শৃঙ্খলাপদ্ধতি বিষয়ে সুস্পষ্ট নীতিমালা প্রণয়ন ও কার্যকর করতে হবে।৬। যৌন অভিমুখিতা ও লিঙ্গপরিচয়ভিত্তিক সংখ্যালঘুদের সুরক্ষায় অবিলম্বে “যৌন অভিমুখিতা ও লিঙ্গপরিচয়ভিত্তিক সংখ্যালঘু সুরক্ষা আইন” প্রণয়ন ও কার্যকর করা হোক।
জেএমবিএফ পুনর্ব্যক্ত করছে যে, বিশ্ববিদ্যালয় জ্ঞান, মুক্তচিন্তা, মানবমর্যাদা ও সমতার নিরাপদ ক্ষেত্র হওয়া উচিত; ভয়, অপমান, বৈষম্য ও নিপীড়নের স্থান নয়। যৌন অভিমুখিতার ভিত্তিতে কারও অধিকার খর্ব করা বা শাস্তি দেওয়ার যেকোনো প্রচেষ্টা বন্ধ করতে হবে এবং সংশ্লিষ্ট সকলের মানবাধিকার নিশ্চিত করতে হবে।

৩০ জুলাই বৃহস্পতিবার ঢাকা বিশ্ববিদ্যালয়ের (ঢাবি) মাস্টারদা সূর্যসেন হলে ‘সমকামিতার অভিযোগে’ বিশ্ববিদ্যালয়ের এক আবাসিক শিক্ষার্থী ‘এক্স’ (ছদ্মনাম) এবং বহিরাগত এক যুবক ‘ওয়াই’কে (ছদ্মনাম) আটক করে হল প্রশাসন শাহবাগ থানা পুলিশের কাছে হস্তান্তর করে।
পরে শাহবাগ থানা কর্তৃপক্ষ মুচলেকা নিয়ে শিক্ষার্থী এক্সকে তাঁর বিভাগের ছাত্র উপদেষ্টার জিম্মায় এবং বহিরাগত যুবক ওয়াইকে একজন সমকামী অধিকারকর্মীর জিম্মায় ছেড়ে দেয়। পরবর্তীতে ওই ঘটনাকে কেন্দ্র করে বিশ্ববিদ্যালয় প্রশাসন শিক্ষার্থী এক্সকে আবাসিক হল থেকে স্থায়ীভাবে বহিষ্কার করে।
অভিযুক্ত শিক্ষার্থী বিশ্ববিদ্যালয়ের ২০২২–২৩ শিক্ষাবর্ষের শিক্ষার্থী। বহিরাগত যুবক ওয়াই ব্যানবেইসে কর্মরত। তাঁর স্থায়ী ঠিকানা ফরিদপুরের ভাঙ্গা উপজেলায় এবং বর্তমানে তিনি রাজধানীর মালিবাগে বসবাস করেন।
৩০ জুলাই সকালে সূর্যসেন হলের আবাসিক শিক্ষার্থী এক্স একটি অনলাইন অ্যাপের মাধ্যমে পরিচিত বহিরাগত যুবক ওয়াইকে হলে আমন্ত্রণ জানান। বহিরাগত যুবক ওয়াই নির্ধারিত ৩৬৬ নম্বর কক্ষে যাওয়ার পরিবর্তে ভুলবশত ৩৬০ নম্বর কক্ষের দরজায় কড়া নাড়েন। এতে ওই কক্ষে অবস্থানরত শিক্ষার্থীদের সন্দেহ হয় এবং তাঁরা ওয়াইকে আটক করে জিজ্ঞাসাবাদ করেন।
জিজ্ঞাসাবাদের একপর্যায়ে শিক্ষার্থীরা জোরপূর্বক ওয়াইয়ের মোবাইল ফোনে থাকা কথোপকথন পরীক্ষা করে এক্সকে শনাক্ত করেন। পরে তাঁরা দুজনের মোবাইল ফোনে সমপ্রেমী ব্যক্তিদের যোগাযোগের একটি অনলাইন অ্যাপ এবং তাঁদের পারস্পরিক যোগাযোগের তথ্য পান। এরপর তাঁরা বিষয়টি হল প্রশাসনকে জানান।
খবর পেয়ে হলের প্রাধ্যক্ষ ও হাউস টিউটররা ঘটনাস্থলে উপস্থিত হয়ে দুজনকে প্রাধ্যক্ষের কক্ষে নিয়ে যান। সেখানে এক্স ও ওয়াই মুচলেকা দেন। পরে প্রশাসন প্রক্টরিয়াল টিমের মাধ্যমে তাঁদের আইনশৃঙ্খলা রক্ষাকারী বাহিনীর কাছে হস্তান্তর করে।
তাঁদের বিরুদ্ধে আইনগত ব্যবস্থা নেওয়ার প্রস্তুতি চলাকালে বিশ্ববিদ্যালয়ের প্রক্টর অফিস শাহবাগ থানার সঙ্গে যোগাযোগ করে। পরে বিভাগের ছাত্র উপদেষ্টা, সংশ্লিষ্ট শিক্ষক এবং বিশ্ববিদ্যালয় প্রশাসনের প্রতিনিধিদের উপস্থিতিতে থানা কর্তৃপক্ষ শিক্ষার্থী এক্সকে তাঁর বিভাগের জিম্মায় ছেড়ে দেয়।
অন্যদিকে, বহিরাগত যুবক ওয়াই শাহবাগ থানায় দেওয়া মুচলেকায় উল্লেখ করেন যে, কাউকে না জানিয়ে হলের একটি কক্ষে প্রবেশ করার কারণে পুলিশ তাঁকে থানায় নিয়ে যায়। তিনি আরও দাবি করেন, ভীত ও চাপের মধ্যে থাকায় তিনি ‘সমকামিতার উদ্দেশ্যে হলে প্রবেশ করেছিলেন’—এমন বক্তব্যসংবলিত আগের মুচলেকাটি লিখেছিলেন।
মুচলেকায় দেওয়া বক্তব্যের ভিত্তিতে বিশ্ববিদ্যালয় প্রশাসন ২০২২–২৩ শিক্ষাবর্ষের ওই শিক্ষার্থীর হলের আসন বাতিল করে এবং তাঁকে সূর্যসেন হল থেকে স্থায়ীভাবে বহিষ্কার করে।
ALERTE BANGLADESH : JMBF condamne fermement et exprime sa profonde préoccupation face à l’interpellation de deux personnes accusées d’homosexualité au Surya Sen Hall de l’Université de Dhaka
Paris, France | 01 août 2026 : JusticeMakers Bangladesh in France (JMBF), organisation internationale de défense des droits humains basée en France, exprime sa profonde préoccupation, sa ferme condamnation et sa protestation face à l’interpellation d’un étudiant résident et d’un jeune homme extérieur, accusés d’homosexualité, au Masterda Surya Sen Hall de l’Université de Dhaka ; à l’examen de leurs téléphones portables personnels ; à leur remise à la police ; ainsi qu’à l’expulsion permanente ultérieure de l’étudiant du foyer universitaire.
Selon des informations publiées dans plusieurs journaux et des renseignements reçus de sources fiables propres à JMBF, le matin du 30 juillet 2026, plusieurs étudiants du Surya Sen Hall ont retenu et interrogé un jeune homme extérieur, puis ont examiné son téléphone portable. À la suite d’allégations selon lesquelles des conversations et des échanges de messages à caractère homosexuel y auraient été découverts, l’administration du foyer et l’équipe du bureau du provost l’ont remis, ainsi que l’étudiant universitaire concerné, au poste de police de Shahbagh. Après avoir obtenu des engagements écrits de leur part, la police a libéré les deux personnes sous la garde de tiers. L’administration universitaire a ensuite annulé l’attribution de chambre de l’étudiant et l’a expulsé définitivement.
JMBF considère fermement que le fait d’humilier publiquement une personne, de fouiller de force son téléphone portable personnel, d’obtenir un engagement écrit sous pression ou de prendre des mesures disciplinaires sans procédure régulière, sur la base de l’orientation sexuelle d’une personne, de ses communications privées ou d’allégations relatives à des relations privées consenties, est contraire aux principes fondamentaux de la dignité humaine, de la vie privée, de l’égalité et du droit à un procès équitable.
L’article 27 de la Constitution du Bangladesh garantit aux citoyens l’égalité devant la loi et l’égale protection de la loi. L’article 31 garantit à toute personne la protection de la loi ainsi que le droit de ne subir aucune mesure portant atteinte à sa vie, sa liberté, son intégrité physique, sa réputation ou ses biens, si ce n’est conformément à la loi. L’article 32 protège le droit à la vie et à la liberté individuelle, tandis que l’article 43 garantit le droit au respect du domicile et à la confidentialité des communications.
En outre, le Bangladesh est État partie au Pacte international relatif aux droits civils et politiques (PIDCP). L’article 17 du Pacte interdit les immixtions illégales ou arbitraires dans la vie privée, tandis que l’article 26 garantit l’égale protection de la loi sans discrimination. De plus, le Comité des droits de l’homme des Nations Unies a reconnu que la discrimination fondée sur l’orientation sexuelle relève de ces protections.
Robert Jean Paul Simon, Conseiller principal de JMBF et militant français renommé des droits des personnes LGBTQ+, a déclaré :
« Aucun établissement d’enseignement ne peut être un lieu de peur, d’humiliation et de discrimination. Harceler une personne, la remettre à la police ou la priver de son droit à l’éducation et au logement en raison de son orientation sexuelle ou de ses communications privées est incompatible avec les principes fondamentaux de dignité humaine, de vie privée et d’égalité. L’Université de Dhaka doit mener une enquête impartiale sur cet incident et assurer la sécurité, la vie privée et l’égalité des droits de tous les étudiants. »
JMBF affirme clairement que le fait d’interpeller une personne, de la remettre à la police ou de l’expulser d’un foyer universitaire uniquement en raison de communications sur une application en ligne, d’échanges de messages privés ou de son orientation sexuelle constitue une violation manifeste de la Constitution du Bangladesh et des droits humains fondamentaux universellement reconnus.
Même lorsqu’il existe une allégation de violation du règlement d’un foyer universitaire, les autorités doivent respecter les garanties d’une procédure régulière, l’équité, la proportionnalité et le droit de se défendre. Avant d’expulser définitivement une personne sur la base d’une accusation, les autorités sont tenues de lui notifier l’accusation par écrit, de communiquer les éléments de preuve pertinents, de garantir une audience indépendante et impartiale et de lui offrir une possibilité effective de contester la décision.
JMBF appelle à l’adoption immédiate des mesures suivantes :
- La décision d’expulser définitivement l’étudiant X et d’annuler son attribution de chambre doit être suspendue, et une enquête indépendante, impartiale et transparente doit être menée.
- Une enquête judiciaire impartiale doit être menée sur les allégations de coercition, d’atteinte à la vie privée et d’abus d’autorité liés à l’interpellation, à l’examen des téléphones portables, à l’obtention des engagements écrits et à la remise à la police.
- L’identité, les informations personnelles et les communications des deux personnes concernées doivent être protégées, et elles doivent être à l’abri de tout harcèlement, menace, humiliation publique ou mesure de représailles à l’avenir.
- L’Université de Dhaka doit garantir un environnement éducatif non discriminatoire, sûr et digne pour tous les étudiants, indépendamment de leur orientation sexuelle ou de leur identité de genre.
- L’administration universitaire doit élaborer et mettre en œuvre des politiques claires relatives aux droits humains, à la vie privée, à la non-discrimination et aux procédures disciplinaires équitables.
La « Loi sur la protection des minorités fondée sur l’orientation sexuelle et l’identité de genre » doit être adoptée et mise en œuvre sans délai afin de protéger les minorités concernées.
JMBF réaffirme que les universités doivent être des espaces sûrs de connaissance, de libre pensée, de dignité humaine et d’égalité — et non des lieux de peur, d’humiliation, de discrimination et de persécution. Toute tentative de restreindre ou de sanctionner les droits d’une personne en raison de son orientation sexuelle doit cesser, et les droits humains de toutes les personnes concernées doivent être garantis.

Bref résumé des faits: (Fondé sur des informations publiées dans la presse et sur les propres sources fiables de JMBF)
Le jeudi 30 juillet, l’administration du foyer a retenu un étudiant résident de l’Université de Dhaka, « X » (pseudonyme), ainsi qu’un jeune homme extérieur, « Y » (pseudonyme), sur des accusations d’homosexualité au Masterda Surya Sen Hall, avant de les remettre au poste de police de Shahbagh.
Les autorités du poste de police de Shahbagh ont ensuite recueilli des engagements écrits et ont remis l’étudiant X à la garde de son conseiller étudiant de département, tandis que Y a été confié à un militant des droits des personnes homosexuelles. Par la suite, l’administration universitaire a définitivement expulsé l’étudiant X du foyer universitaire.
L’étudiant concerné appartient à la promotion universitaire 2022-2023. Le jeune homme extérieur, Y, travaille à BANBEIS. Son adresse permanente se situe dans l’upazila de Bhanga, dans le district de Faridpur, et il réside actuellement à Malibagh, à Dhaka.
Le matin du 30 juillet, l’étudiant X, résident du Surya Sen Hall, a invité Y, qu’il connaissait par l’intermédiaire d’une application en ligne, à se rendre au foyer. Au lieu de se rendre dans la chambre no 366 prévue à cet effet, Y a, par erreur, frappé à la porte de la chambre no 360. Les étudiants présents dans cette chambre ont eu des soupçons et l’ont retenu puis interrogé.
Au cours de l’interrogatoire, les étudiants auraient examiné de force le téléphone portable de Y et identifié X. Ils auraient ensuite trouvé, sur les téléphones des deux personnes, une application en ligne utilisée par des personnes de même sexe pour communiquer, ainsi que des informations concernant leurs échanges mutuels. Les étudiants ont alors informé l’administration du foyer.
Après avoir été informés, le Provost et les tuteurs du foyer se sont rendus sur les lieux et ont conduit les deux personnes au bureau du Provost, où X et Y ont signé des engagements écrits. L’administration les a ensuite remis aux forces de l’ordre par l’intermédiaire de l’équipe du bureau du provost.
Alors que les autorités se préparaient à engager des poursuites à leur encontre, le bureau du Provost de l’université a contacté le poste de police de Shahbagh. Par la suite, en présence du conseiller étudiant du département, d’enseignants concernés et de représentants de l’administration universitaire, la police a remis l’étudiant X à la garde de son département.
Entre-temps, Y a déclaré dans un engagement écrit soumis au poste de police de Shahbagh que la police l’avait conduit au commissariat parce qu’il était entré dans une chambre du foyer sans en informer personne. Il a également affirmé que, alors qu’il était effrayé et sous pression, il avait rédigé le précédent engagement contenant l’affirmation selon laquelle il était entré dans le foyer « dans le but de se livrer à des actes homosexuels ».
Sur la base de la déclaration contenue dans cet engagement, l’administration universitaire a annulé l’attribution de chambre de l’étudiant de la promotion 2022-2023 et l’a définitivement expulsé du Surya Sen Hall.
