BANGLADESH: JMBF Calls for an Impartial Investigation into the Alleged Extrajudicial Killing and Subsequent Disappearance of the Body by the Coast Guard

Paris, France; 1 June 2025: JusticeMakers Bangladesh in France (JMBF), a France-based human rights organization, expresses deep concern and strong condemnation regarding the incident on the night of Monday, 19 May 2025, when Mohammad Taher was killed by gunfire from members of the Bangladesh Coast Guard while fishing in the coastal area of Teknaf. His body was later allegedly disappeared. In the same incident, another individual named Abdul Shukkur was injured by gunfire.

JMBF believes that allegations of extrajudicial killings and enforced disappearances by law enforcement agencies during operations are grave violations of human rights. It is the constitutional responsibility of the state and its forces to ensure the safety and security of citizens. However, such allegations against state forces are alarming and unacceptable.

According to various media reports, on the night of 19 May, seven fishermen, including Mohammad Taher, went fishing when Taher was shot dead by the Coast Guard. His body was reportedly packed and taken in an autorickshaw towards Shahparir Dwip, but his family never received the body. On the other hand, the Coast Guard denied the allegation, stating that during the operation at Tulatoli Ghat in Teknaf, they apprehended Abdul Shukkur—who had been shot—and two others named Md. Elias and Nur Mohammad. Shukkur was admitted to Cox's Bazar Sadar Hospital.

Renowned French human rights activist and chief advisor to JMBF, Robert Simon, stated, “If allegations of human rights violations are made against law enforcement agencies, it is the legal duty of the state to ensure an impartial investigation. However, the Bangladesh government often conducts superficial investigations into extrajudicial killings. Therefore, it is crucial to involve international human rights organizations to uncover the full truth of this incident.”

Bangladeshi human rights lawyer and founding president of JMBF, Advocate Shahanur Islam, said, “While extrajudicial killings had declined towards the end of the previous government’s tenure, such incidents have worryingly reemerged under the interim government led by Nobel Peace Prize laureate Dr. Muhammad Yunus, which contradicts international human rights law. If the allegations regarding Mohammad Taher’s disappearance and the concealment of his body are not properly investigated, it will further deepen the culture of impunity in the country. Therefore, a transparent and impartial investigation under the supervision of the United Nations is essential.”

JMBF Urgently Demands:

1. Impartial and thorough investigation under UN supervision: The killing of Mohammad Taher and the subsequent disappearance of his body, as well as the shooting and injury of Abdul Shukkur, must be thoroughly and independently investigated under the supervision of the United Nations to reveal the full truth.
2. Accountability of accused Coast Guard personnel: Those responsible for Taher’s killing, body disappearance, and the shooting of Shukkur must be identified and held accountable through a fair and transparent trial. The state must take effective measures to end impunity.
3. Institutional and legal reforms to prevent recurrence: Mandatory human rights training, the use of body cameras during operations, and the establishment of independent investigative mechanisms must be ensured to prevent future occurrences of such incidents.
4. Compensation and psychological support for victims’ families: The families of Mohammad Taher and the injured Abdul Shukkur must be provided with appropriate financial compensation, legal assistance, and mental health support.

In the interest of human rights and justice, JMBF calls upon the state and relevant authorities to take immediate and effective action.

সংবাদ ও গণবিবৃতি: কোস্টগার্ড কর্তৃক বিচারবহির্ভূত হত্যা ও পরবর্তীতে লাশ গুমের ঘটনায় নিরপেক্ষ তদন্তের আহ্বান জানিয়েছে জেএমবিএফ

প্যারিস, ফ্রান্স; ১ জুন ২০২৫: গত ১৯ মে ২০২৫, সোমবার রাতে মাছ ধরতে গেলে টেকনাফের উপকূলীয় এলাকায় কোস্টগার্ড সদস্যদের গুলিতে মোহাম্মদ তাহেরের মৃত্যু ও পরবর্তীতে তার মরদেহ গুম এবং একই ঘটনায় আবদুল শুক্কুর নামের অপর এক ব্যক্তি গুলিবিদ্ধ হয়ে আহত হওয়ার ঘটনায় ফ্রান্সভিত্তিক মানবাধিকার সংগঠন জাস্টিসমেকার্স বাংলাদেশ ইন ফ্রান্স (জেএমবিএফ) গভীর উদ্বেগ ও তীব্র ক্ষোভ প্রকাশ করছে।

জেএমবিএফ মনে করে, অভিযানের সময় আইন-শৃঙ্খলা রক্ষাকারী বাহিনীর বিরুদ্ধে বিচারবহির্ভূত হত্যা ও গুমের মতো গুরুতর অভিযোগ মানবাধিকারের চরম লঙ্ঘন। নাগরিকের জীবনের নিরাপত্তা নিশ্চিত করা রাষ্ট্র ও সংশ্লিষ্ট বাহিনীগুলোর সাংবিধানিক দায়িত্ব। অথচ সেই বাহিনীর সদস্যদের বিরুদ্ধেই এ ধরনের অভিযোগ অত্যন্ত উদ্বেগজনক ও অনভিপ্রেত।

বিভিন্ন সংবাদমাধ্যমে প্রকাশিত প্রতিবেদনে জানা যায়, গত ১৯ মে রাতে মোহাম্মদ তাহেরসহ সাতজন জেলে মাছ ধরতে গেলে কোস্টগার্ডের গুলিতে তাহের নিহত হন। পরে তাহেরের মরদেহ প্যাকেটে ভরে অটোরিকশায় শাহপরীর দ্বীপের দিকে নিয়ে যাওয়া হয়, কিন্তু নিহতের পরিবার মরদেহ বুঝে পায়নি। অন্যদিকে, কোস্টগার্ডের পক্ষ থেকে অভিযোগ অস্বীকার করে জানানো হয় যে, টেকনাফের তুলাতলী ঘাট এলাকায় অভিযানে তারা গুলিবিদ্ধ আবদুল শুক্কুরসহ মো. ইলিয়াস ও নুর মোহাম্মদকে আটক করে। শুক্কুরকে কক্সবাজার সদর হাসপাতালে ভর্তি করা হয়েছে।

বিশিষ্ট ফরাসি মানবাধিকারকর্মী ও জেএমবিএফ-এর প্রধান উপদেষ্টা রবার্ট সাইমন বলেন, "আইন-শৃঙ্খলা রক্ষাকারী বাহিনীর বিরুদ্ধে যদি মানবাধিকার লঙ্ঘনের অভিযোগ ওঠে, তবে তার নিরপেক্ষ তদন্ত নিশ্চিত করা রাষ্ট্রের আইনি দায়িত্ব। কিন্তু বাংলাদেশ সরকার প্রায়শই বিচারবহির্ভূত হত্যাকাণ্ডের ঘটনায় দায়সারা তদন্ত করে থাকে। তাই, এ ঘটনার প্রকৃত সত্য উদ্ঘাটনে আন্তর্জাতিক মানবাধিকার সংস্থাকে সম্পৃক্ত করা জরুরি।"

বাংলাদেশি মানবাধিকার আইনজীবী ও জেএমবিএফ-এর প্রতিষ্ঠাতা সভাপতি অ্যাডভোকেট শাহানূর ইসলাম বলেন, "বিগত সরকারের শেষের দিকে বাংলাদেশে বিচারবহির্ভূত হত্যাকাণ্ড বন্ধ হলেও বর্তমান শান্তিতে নোবেল বিজয়ী মোহাম্মদ ইউনুসের নেতৃত্বাধীন অন্তর্বর্তীকালীন সরকারের সময়ে আবারও তা উদ্বেগজনকভাবে শুরু হয়েছে, যা আন্তর্জাতিক মানবাধিকার আইনের পরিপন্থী। মোহাম্মদ তাহেরের নিখোঁজ হওয়া ও লাশ গুমের অভিযোগের সুষ্ঠু তদন্ত না হলে দেশের বিচারহীনতার সংস্কৃতি আরও গভীর হবে। তাই জাতিসংঘের তত্ত্বাবধানে এই ঘটনার নিরপেক্ষ ও স্বচ্ছ তদন্ত কার্যক্রম জরুরি।"

জাস্টিসমেকার্স বাংলাদেশ ইন ফ্রান্স (জেএমবিএফ)-এর জোর দাবি:

১. জাতিসংঘের তত্ত্বাবধানে নিরপেক্ষ ও সুষ্ঠু তদন্ত করতে হবেঃ মোহাম্মদ তাহেরকে গুলি করে হত্যা ও পরবর্তীতে লাশ গুম, এবং আবদুল শুক্কুরকে গুলি করে আহত করার ঘটনায় অবিলম্বে জাতিসংঘের তত্ত্বাবধানে নিরপেক্ষ ও সুষ্ঠু তদন্তের মাধ্যমে প্রকৃত ঘটনা উদ্ঘাটন নিশ্চিত করতে হবে।

২. অভিযুক্ত কোস্টগার্ড সদস্যদের জবাবদিহির আওতায় আনতে হবেঃ তাহেরের হত্যা, লাশ গুম ও শুক্কুরকে গুলিবিদ্ধ করার জন্য দায়ী ব্যক্তিদের চিহ্নিত করে স্বচ্ছ ও নিরপেক্ষে বিচারে দায়ীদের দৃষ্টান্তমূলক শাস্তি প্রদান করতে হবে এবং বিচারহীনতা রোধ করতে রাষ্ট্রকে কার্যকর পদক্ষেপ নিতে হবে।

৩. ভবিষ্যতে এমন ঘটনার পুনরাবৃত্তি রোধে আইনি ও প্রাতিষ্ঠানিক ব্যবস্থা গ্রহণ করতে হবেঃ মানবাধিকার বিষয়ক বাধ্যতামূলক প্রশিক্ষণ, অভিযানে বডি-ক্যামেরা ব্যবহার, এবং স্বাধীন তদন্ত কাঠামো গঠন নিশ্চিত করতে হবে।

৪. ভিকটিমদের পরিবারকে ক্ষতিপূরণ ও মানসিক সহায়তা প্রদান করতে হবেঃ তাহেরের পরিবার এবং গুলিবিদ্ধ আবদুল শুক্কুরের পরিবারকে উপযুক্ত আর্থিক ক্ষতিপূরণ, আইনি সহায়তা ও মানসিক স্বাস্থ্যসেবা দিতে হবে।

মানবাধিকার রক্ষা ও ন্যায়বিচারের স্বার্থে জেএমবিএফ রাষ্ট্র ও সংশ্লিষ্ট কর্তৃপক্ষকে অবিলম্বে কার্যকর ব্যবস্থা গ্রহণের আহ্বান জানাচ্ছে।

BANGLADESH : JMBF demande une enquête impartiale sur le prétendu meurtre extrajudiciaire et la disparition ultérieure du corps par la garde côtière

Paris, France ; 1er juin 2025 : JusticeMakers Bangladesh en France (JMBF), une organisation de défense des droits humains basée en France, exprime sa profonde inquiétude et sa vive condamnation concernant l’incident survenu dans la nuit du lundi 19 mai 2025, lorsque Mohammad Taher a été tué par des tirs des membres de la garde côtière du Bangladesh alors qu’il pêchait dans la zone côtière de Teknaf. Son corps aurait ensuite disparu. Lors du même incident, un autre individu nommé Abdul Shukkur a été blessé par balle.

JMBF considère que les allégations de meurtres extrajudiciaires et de disparitions forcées perpétrés par les forces de l’ordre lors d’opérations sont de graves violations des droits humains. Il est de la responsabilité constitutionnelle de l’État et de ses forces d’assurer la sécurité et la protection des citoyens. Cependant, de telles accusations portées contre les forces de l’État sont alarmantes et inacceptables.

Selon plusieurs rapports médiatiques, dans la nuit du 19 mai, sept pêcheurs, dont Mohammad Taher, sont allés pêcher lorsque Taher a été abattu par la garde côtière. Son corps aurait été emballé et transporté dans un autorickshaw en direction de l’île Shahparir, mais sa famille n’a jamais reçu le corps. Par ailleurs, la garde côtière a nié ces allégations, affirmant que lors d’une opération au quai de Tulatoli à Teknaf, elle avait arrêté Abdul Shukkur — qui avait été blessé par balle — ainsi que deux autres personnes nommées Md. Elias et Nur Mohammad. Shukkur a été admis à l’hôpital central de Cox’s Bazar.

Le célèbre militant français des droits humains et principal conseiller de la JMBF, Robert Simon, a déclaré : « Si des allégations de violations des droits humains sont portées contre les forces de l’ordre, il est du devoir légal de l’État de garantir une enquête impartiale. Toutefois, le gouvernement bangladais mène souvent des enquêtes superficielles sur les meurtres extrajudiciaires. Il est donc crucial d’impliquer des organisations internationales de défense des droits humains pour découvrir toute la vérité sur cet incident. »

L’avocat bangladais des droits humains et président fondateur de la JMBF, Maître Shahanur Islam, a déclaré : « Alors que les meurtres extrajudiciaires avaient diminué vers la fin du mandat du gouvernement précédent, ces incidents ont malheureusement réémergé sous le gouvernement intérimaire dirigé par le lauréat du prix Nobel de la paix, Dr Muhammad Yunus, ce qui est contraire au droit international des droits humains. Si les allégations concernant la disparition de Mohammad Taher et la dissimulation de son corps ne sont pas correctement enquêtées, cela approfondira encore davantage la culture de l’impunité dans le pays. Par conséquent, une enquête transparente et impartiale sous la supervision des Nations Unies est essentielle. »

Demandes urgentes de la JMBF :

1. Enquête impartiale et approfondie sous supervision de l’ONU : Le meurtre de Mohammad Taher, la disparition ultérieure de son corps ainsi que la blessure par balle d’Abdul Shukkur doivent faire l’objet d’une enquête indépendante et approfondie sous la supervision des Nations Unies afin de révéler toute la vérité.
2. Responsabilité des membres accusés de la garde côtière : Les responsables du meurtre de Taher, de la disparition du corps et de la blessure de Shukkur doivent être identifiés et tenus responsables dans le cadre d’un procès juste et transparent. L’État doit prendre des mesures efficaces pour mettre fin à l’impunité.
3. Réformes institutionnelles et juridiques pour prévenir la récidive : Une formation obligatoire aux droits humains, l’utilisation de caméras corporelles lors des opérations, ainsi que la mise en place de mécanismes d’enquête indépendants doivent être assurées pour éviter la répétition de tels incidents.
4. Indemnisation et soutien psychologique aux familles des victimes : Les familles de Mohammad Taher et d’Abdul Shukkur blessé doivent bénéficier d’une compensation financière appropriée, d’une assistance juridique et d’un soutien psychologique.

Dans l’intérêt des droits humains et de la justice, la JMBF appelle l’État et les autorités compétentes à prendre des mesures immédiates et efficaces.
