JMBF strongly believes that this decision is not only unjust; it is a blatant and dangerous attack on the core principles of democracy, the rule of law, and the independence of the legal profession. The exclusion of candidates based on alleged political affiliation constitutes political discrimination that has no place in any credible legal institution.
According to news published in different media outlets and information verified by reliable sources of JMBF, on Tuesday, April 28, the SCBA cancelled the nomination papers of more than 20 candidates allegedly affiliated with the Awami League.
Earlier, on Sunday, April 26, the SCBA ad hoc committee, at an extraordinary general meeting held at the bar auditorium, decided to bar pro–Awami League lawyers from participating in the election. Around 300 lawyers attended the meeting, most of whom were reportedly supporters of the BNP, Jamaat-e-Islami, and the Bangladesh Citizens Party (NCP).
It has also been reported that around 100 pro–BNP, Jamaat, and NCP lawyers had earlier requested the bar leadership to convene the meeting to decide on barring pro–Awami League lawyers from contesting the election, citing the ban on the party’s activities.
Under this decision, lawyers who are supporters of the Sammilita Ainjibi Samannay Parishad, backed by the Awami League, and who have held positions within those bodies will not be permitted to run in the SCBA polls.
Advocate Shahanur Islam, Founder President of JMBF, stated
, "By imposing such restrictions, the SCBA has abandoned its duty to uphold fairness and neutrality and has instead chosen to act as an instrument of political exclusion. This move sets a deeply troubling precedent, transforming a professional body into a platform for partisan control and silencing dissenting voices within the legal community."
JMBF is particularly outraged by the requirement that lawyers must formally declare non-affiliation with a specific political party in order to be eligible to contest. This is a coercive and unacceptable condition that directly violates the fundamental right to freedom of association and expression. Such measures reflect authoritarian tendencies and undermine the very foundations of a free and independent legal profession.
In addition, JMBF believes that the circumstances surrounding this decision—driven by politically aligned groups and lacking genuine inclusivity—raise serious concerns about the legitimacy, transparency, and integrity of the process. What should have been a fair and democratic exercise has instead been reduced to a politically motivated exclusionary mechanism.
JMBF unequivocally asserts that no lawyer should be denied the right to participate in professional elections on political grounds. The legal profession must not be weaponized to serve partisan interests.
JMBF therefore demands:
- The immediate and unconditional reversal of this unlawful and discriminatory decision;
- The reinstatement of all disqualified candidates, ensuring a free, fair, and inclusive electoral process;
- Accountability for those responsible for undermining the independence and credibility of the SCBA;
JMBF also urges urgent attention from the national and international legal community to confront and resist this erosion of democratic and professional norms.
JMBF warns that such actions, if left unchallenged, will have far-reaching consequences for the independence of the legal profession and the rule of law in Bangladesh.

ALERTE BANGLADESH : JMBF profondément préoccupée par l’annulation des candidatures de 20 avocats pro-AL aux élections du SCBA
Paris, France | 28 avril 2026 : JusticeMakers Bangladesh in France (JMBF) condamne fermement la décision de la Supreme Court Bar Association (SCBA) d’annuler les dossiers de candidature de plus de 20 avocats prétendument affiliés à la Ligue Awami, les empêchant ainsi de se présenter aux élections du SCBA prévues les 13 et 14 mai 2026.
JMBF estime fermement que cette décision n’est pas seulement injuste ; elle constitue une attaque flagrante et dangereuse contre les principes fondamentaux de la démocratie, de l’État de droit et de l’indépendance de la profession juridique. L’exclusion de candidats sur la base d’une affiliation politique présumée constitue une discrimination politique qui n’a pas sa place dans une institution juridique crédible.
Selon des informations publiées dans différents médias et vérifiées par des sources fiables de JMBF, le mardi 28 avril, la SCBA a annulé les candidatures de plus de 20 candidats prétendument affiliés à la Ligue Awami.
Plus tôt, le dimanche 26 avril, le comité ad hoc de la SCBA, lors d’une assemblée générale extraordinaire tenue à l’auditorium du barreau, a décidé d’exclure les avocats pro–Ligue Awami de la participation aux élections. Environ 300 avocats ont assisté à la réunion, dont la plupart étaient, selon les informations, des partisans du BNP, de Jamaat-e-Islami et du Bangladesh Citizens Party (NCP).
Il a également été rapporté qu’environ 100 avocats proches du BNP, de Jamaat et du NCP avaient auparavant demandé à la direction du barreau de convoquer cette réunion afin de décider de l’exclusion des avocats pro–Ligue Awami des élections, en invoquant l’interdiction des activités du parti.
En vertu de cette décision, les avocats soutenant le Sammilita Ainjibi Samannay Parishad, soutenu par la Ligue Awami, et ayant occupé des postes au sein de ces structures ne seront pas autorisés à se présenter aux élections du SCBA.
L’avocat Shahanur Islam, président fondateur de JMBF, a déclaré :
« En imposant de telles restrictions, la SCBA a abandonné son devoir de garantir l’équité et la neutralité et a choisi d’agir comme un instrument d’exclusion politique. Cette décision établit un précédent profondément inquiétant, transformant une organisation professionnelle en une plateforme de contrôle partisan et réduisant au silence les voix dissidentes au sein de la communauté juridique. »
JMBF est particulièrement indignée par l’obligation faite aux avocats de déclarer formellement leur non-affiliation à un parti politique spécifique pour pouvoir se présenter. Il s’agit d’une condition coercitive et inacceptable qui viole directement le droit fondamental à la liberté d’association et d’expression. De telles mesures reflètent des tendances autoritaires et sapent les fondements mêmes d’une profession juridique libre et indépendante.
En outre, JMBF estime que les circonstances entourant cette décision — influencées par des groupes politiquement alignés et dépourvues d’une véritable inclusivité — soulèvent de sérieuses inquiétudes quant à la légitimité, la transparence et l’intégrité du processus. Ce qui aurait dû être un exercice démocratique et équitable a été réduit à un mécanisme d’exclusion politiquement motivé.
JMBF affirme sans équivoque qu’aucun avocat ne doit être privé du droit de participer aux élections professionnelles pour des raisons politiques. La profession juridique ne doit pas être instrumentalisée au service d’intérêts partisans.
JMBF exige donc :
La révocation immédiate et inconditionnelle de cette décision illégale et discriminatoire ;La réintégration de tous les candidats disqualifiés, garantissant un processus électoral libre, équitable et inclusif ;La mise en cause des responsables ayant compromis l’indépendance et la crédibilité de la SCBA ;
JMBF appelle également à une attention urgente de la part de la communauté juridique nationale et internationale afin de faire face et de résister à cette érosion des normes démocratiques et professionnelles.
JMBF avertit que de telles actions, si elles ne sont pas contestées, auront des conséquences profondes sur l’indépendance de la profession juridique et l’État de droit au Bangladesh.
JMBF reste fermement engagée en faveur de la justice, des droits fondamentaux et de la protection des valeurs démocratiques.
