URGENT ACTION REQUESTED: Seeking Independent Investigation and Accountability for the Death of Mr. Asaduzzaman Asad in Bogura DB Police Custody

Greetings from JusticeMakers Bangladesh in France (JMBF).
JMBF urgently seeks your intervention regarding the reported death of Mr. Asaduzzaman Asad (25) while in the custody of the District Detective Branch (DB) Police in Bogura, Bangladesh, on 19 July 2026, allegedly following torture in police custody.
According to reliable sources and media reports, Mr. Asaduzzaman Asad was arrested by the Bogura District DB Police on 18 July 2026 as a suspect in connection with the murder of a CNG-powered auto-rickshaw driver. Before he could be produced before a court, he died on the morning of 19 July 2026 while being held in the DB Police detention cell. While the DB Police claimed that he died by suicide, members of his family have alleged that he was subjected to torture while in police custody and that his death has been falsely portrayed as suicide.
These conflicting accounts require an independent, impartial, transparent, and credible investigation to establish the truth, determine the actual circumstances surrounding his death, and ensure accountability for any violations, negligence, or wrongdoing.
We urge you to write to the Honourable Prime Minister of Bangladesh, copying the relevant authorities listed in the Urgent Appeal below, calling for an independent investigation, accountability for any individuals found responsible, protection of the rights of the deceased’s family, and effective measures to prevent torture and deaths in police custody.

Subject: Urgent Appeal for an Independent, Judicial, and International Standards-Compliant Investigation into the Death of Mr. Asaduzzaman Asad in the Custody of the Bogura District Detective Branch (DB) Police and for Appropriate Legal Action
Honorable Prime Minister,
On behalf of JusticeMakers Bangladesh in France (JMBF), a France-based international human rights organization established in accordance with the principles and values of the International Bill of Human Rights, I extend my sincere greetings to you.
According to reports published by various national media outlets, as well as information obtained through JMBF's own credible sources, Mr. Asaduzzaman Asad (25) was arrested by the District Detective Branch (DB) Police in Boguraon 18 July 2026 as a suspect in the murder of a CNG-powered auto-rickshaw driver. On the morning of 19 July 2026, before he could be produced before a court, he died while being held in the detention cell of the DB office.
According to the DB Police, Mr. Asad died by suicide after allegedly hanging himself with a lungi tied to the ventilation grill inside the detention cell's toilet. However, members of the deceased's family have alleged that he was subjected to torture while in police custody and that his death is being falsely portrayed as a suicide. These conflicting accounts underscore the urgent need for an independent, impartial, transparent, and credible investigation to determine the true cause and circumstances of his death and to establish accountability for any wrongdoing.
As this incident occurred entirely while Mr. Asad was under the custody and control of the State, serious questions arise as to whether the responsible authorities fulfilled their duty to protect his life and ensure his safety; whether he was subjected to torture, cruel, inhuman, or degrading treatment or punishment; and whether any negligence, misconduct, abuse of authority, or dereliction of duty occurred on the part of the officials responsible for his custody.
Any death occurring in police custody constitutes a matter of grave concern under the Constitution of Bangladesh, international human rights law, and Bangladesh's international legal obligations. Article 6 of the International Covenant on Civil and Political Rights (ICCPR) guarantees every individual's inherent right to life. Likewise, the United Nations Convention against Torture (UNCAT) and the Minnesota Protocol on the Investigation of Potentially Unlawful Death (2016) require States to conduct prompt, independent, impartial, effective, transparent, and credible investigations into every death occurring in State custody.
Furthermore, the Constitution of Bangladesh guarantees every citizen the rights to life, personal liberty, and equal protection of the law. Regardless of whether a person is an accused or merely a suspect, the State bears full responsibility for protecting the life and security of any individual held in its custody. Consequently, every custodial death raises fundamental concerns regarding justice, accountability, and public confidence in law enforcement institutions.
In light of the above, we respectfully urge your Government to:
- Establish an independent, judicial, impartial, transparent, prompt, and effective investigation into the death of Mr. Asaduzzaman Asad while in the custody of the Bogura District Detective Branch (DB) Police, with the participation, observation, or technical assistance of international human rights experts.
- Ensure that the investigation is conducted in full compliance with the Minnesota Protocol on the Investigation of Potentially Unlawful Death (2016) and that all relevant evidence—including CCTV footage, detention registers, duty rosters, medical records, forensic evidence, autopsy reports, witness statements, and all other relevant materials—is promptly preserved, secured, and examined.
- If the investigation reveals evidence of negligence, torture, abuse of authority, or any other unlawful conduct by any police officer or other individual, ensure that those responsible are prosecuted under the applicable laws and held accountable through an independent, impartial, and transparent judicial process, with appropriate penalties imposed upon conviction.
- Ensure that the deceased's family is regularly informed of the progress of the investigation, provided with appropriate legal assistance, and afforded full and effective access to justice.
- Strengthen safety measures, healthcare services, effective CCTV monitoring systems, independent inspection and oversight mechanisms, and custodial safeguards in all police detention facilities, Detective Branch offices, and other places of detention throughout Bangladesh in accordance with international human rights standards, in order to prevent similar incidents in the future.
- Provide the deceased's family with appropriate psychosocial support, legal assistance, and, where applicable, adequate, effective, and prompt compensation in accordance with the law and international human rights standards.
- Ensure the safety and protection of the deceased's family members, legal representatives, witnesses, and any other persons cooperating with the investigation so that they are not subjected to intimidation, harassment, retaliation, or any other form of pressure in connection with this case.
- Adopt effective legislative, administrative, and institutional measures to prevent torture and deaths in police custody, strengthen accountability mechanisms, ensure prompt investigations into all allegations of custodial abuse, and provide regular human rights-based training for law enforcement personnel in accordance with Bangladesh's international human rights obligations.
Honorable Prime Minister,
We firmly believe that your Government remains committed to upholding the rule of law, protecting human rights, and maintaining public confidence in the administration of justice. It is in this spirit that we respectfully urge you to treat this custodial death with the utmost seriousness by ensuring an independent, impartial, transparent, and credible investigation, effective accountability, and appropriate legal action against any individuals found responsible.
We further hope that a transparent investigation will establish the truth, ensure justice for the victim's family, and contribute to meaningful institutional reforms aimed at preventing future incidents of torture and deaths in police custody.
We would appreciate receiving information regarding any measures taken in response to this appeal for our records.

জাতিসংঘের আন্তর্জাতিক মানবাধিকার সনদ (International Bill of Human Rights)-এর আদর্শ ও নীতিমালার আলোকে প্রতিষ্ঠিত ফ্রান্সভিত্তিক আন্তর্জাতিক মানবাধিকার সংগঠন জাস্টিসমেকার্স বাংলাদেশ ইন ফ্রান্স (জেএমবিএফ)-এর পক্ষ থেকে আপনাকে আন্তরিক শুভেচ্ছা জানাচ্ছি।
বিভিন্ন জাতীয় গণমাধ্যমে প্রকাশিত সংবাদ এবং জেএমবিএফ-এর নিজস্ব নির্ভরযোগ্য সূত্রে প্রাপ্ত তথ্য অনুযায়ী, ১৮ জুলাই ২০২৬তারিখে বগুড়া শহর থেকে সিএনজিচালিত অটোরিকশা চালক হত্যা মামলার সন্দেহভাজন হিসেবে আসাদুজ্জামান আসাদ (২৫)-কে জেলা গোয়েন্দা (ডিবি) পুলিশ আটক করে। পরদিন ১৯ জুলাই ২০২৬ সকালে আদালতে হাজির করার পূর্বে ডিবি কার্যালয়ের হাজতখানায় তাঁর মৃত্যু ঘটে।
ডিবি পুলিশের দাবি অনুযায়ী, তিনি হাজতখানার শৌচাগারের ভেন্টিলেশনের সঙ্গে লুঙ্গি পেঁচিয়ে আত্মহত্যা করেছেন। তবে নিহতের পরিবারের সদস্যরা অভিযোগ করেছেন যে, তাঁকে পুলিশি হেফাজতে নির্যাতনের মাধ্যমে হত্যা করা হয়েছে এবং ঘটনাটিকে আত্মহত্যা হিসেবে উপস্থাপনের চেষ্টা করা হচ্ছে। এই পরস্পরবিরোধী বক্তব্য ঘটনাটির প্রকৃত কারণ, মৃত্যুর প্রকৃতি এবং সংশ্লিষ্ট ব্যক্তিদের দায়-দায়িত্ব নির্ধারণের জন্য একটি স্বাধীন, নিরপেক্ষ, স্বচ্ছ ও বিশ্বাসযোগ্য তদন্তের প্রয়োজনীয়তাকে আরও জোরালো করেছে।
ঘটনাটি সম্পূর্ণরূপে রাষ্ট্রের হেফাজতে সংঘটিত হওয়ায় এর প্রকৃত কারণ, তাঁর নিরাপত্তা নিশ্চিত করতে সংশ্লিষ্ট কর্তৃপক্ষ যথাযথ ব্যবস্থা গ্রহণ করেছিল কি না, তাঁর প্রতি কোনো ধরনের নির্যাতন, নিষ্ঠুর, অমানবিক বা অবমাননাকর আচরণ করা হয়েছিল কি না, কিংবা কর্তব্যরত কর্মকর্তাদের কোনো অবহেলা, গাফিলতি বা দায়িত্বে ব্যর্থতা ছিল কি না—এসব বিষয়ে গুরুতর প্রশ্নের উদ্ভব হয়েছে।
পুলিশ হেফাজতে কোনো ব্যক্তির মৃত্যু বাংলাদেশের সংবিধান, আন্তর্জাতিক মানবাধিকার আইন এবং বাংলাদেশের আন্তর্জাতিক অঙ্গীকারের আলোকে অত্যন্ত গুরুতর উদ্বেগের বিষয়। আন্তর্জাতিক নাগরিক ও রাজনৈতিক অধিকার সম্পর্কিত চুক্তি (ICCPR)-এর ৬ নম্বর অনুচ্ছেদ প্রত্যেক ব্যক্তির জীবনের অধিকার নিশ্চিত করেছে। একইভাবে জাতিসংঘের নির্যাতনবিরোধী সনদ (UNCAT) এবং Minnesota Protocol on the Investigation of Potentially Unlawful Death (2016) অনুযায়ী, রাষ্ট্রের হেফাজতে সংঘটিত প্রতিটি মৃত্যুর ঘটনায় দ্রুত, স্বাধীন, নিরপেক্ষ, কার্যকর, স্বচ্ছ ও বিশ্বাসযোগ্য তদন্ত পরিচালনা করা রাষ্ট্রের আন্তর্জাতিক বাধ্যবাধকতা।
তাছাড়া, বাংলাদেশের সংবিধান প্রত্যেক নাগরিকের জীবন, ব্যক্তিস্বাধীনতা এবং আইনের সমান সুরক্ষার নিশ্চয়তা প্রদান করেছে। রাষ্ট্রের হেফাজতে থাকা কোনো ব্যক্তি অভিযুক্ত বা সন্দেহভাজন হলেও তাঁর জীবন ও নিরাপত্তা নিশ্চিত করার পূর্ণ দায়িত্ব রাষ্ট্রের ওপর বর্তায়। ফলে পুলিশ হেফাজতে সংঘটিত যেকোনো মৃত্যু ন্যায়বিচার, জবাবদিহিতা এবং আইনশৃঙ্খলা রক্ষাকারী বাহিনীর প্রতি জনগণের আস্থার প্রশ্নকে গভীরভাবে স্পর্শ করে।
অতএব, আপনার নিকট বিনীতভাবে আবেদন জানাচ্ছি যে—
১। আন্তর্জাতিক মানবাধিকার বিশেষজ্ঞদের পর্যবেক্ষণ বা কারিগরি সহায়তায় বগুড়া ডিবি পুলিশ হেফাজতে আসাদুজ্জামান আসাদের মৃত্যুর ঘটনায় একটি বিচার বিভাগীয়, স্বাধীন, নিরপেক্ষ, স্বচ্ছ ও সময়োপযোগী তদন্ত পরিচালনার ব্যবস্থা গ্রহণ করা হোক।২। তদন্ত কার্যক্রম Minnesota Protocol on the Investigation of Potentially Unlawful Death (2016) অনুযায়ী পরিচালনা নিশ্চিত করা হোক এবং সকল আলামত, সিসিটিভি ফুটেজ, হাজতখানার রেজিস্টার, ডিউটি রোস্টার, চিকিৎসা-সংক্রান্ত নথি, ময়নাতদন্ত প্রতিবেদন এবং অন্যান্য প্রাসঙ্গিক তথ্য যথাযথভাবে সংরক্ষণ ও সুরক্ষিত রাখা হোক।৩। তদন্তে যদি কোনো পুলিশ সদস্য বা অন্য কোনো ব্যক্তির বিরুদ্ধে অবহেলা, নির্যাতন, ক্ষমতার অপব্যবহার বা অন্য কোনো বেআইনি কর্মকাণ্ডের প্রমাণ পাওয়া যায়, তবে তাঁদের বিরুদ্ধে প্রচলিত আইন অনুযায়ী ব্যবস্থা গ্রহণ করে স্বচ্ছ, স্বাধীন ও নিরপেক্ষ বিচারের মাধ্যমে দৃষ্টান্তমূলক শাস্তি নিশ্চিত করা হোক।৪। মৃত ব্যক্তির পরিবারের সদস্যদের তদন্তের অগ্রগতি সম্পর্কে নিয়মিত অবহিত করা, তাঁদের প্রয়োজনীয় আইনগত সহায়তা নিশ্চিত করা এবং ন্যায়বিচার প্রাপ্তির পূর্ণ সুযোগ প্রদান করা হোক।৫। দেশের সকল পুলিশ হেফাজত, ডিবি কার্যালয় ও আটককেন্দ্রে আন্তর্জাতিক মানবাধিকার মানদণ্ড অনুযায়ী নিরাপত্তা ব্যবস্থা, স্বাস্থ্যসেবা, কার্যকর সিসিটিভি পর্যবেক্ষণ এবং স্বাধীন তদারকি ব্যবস্থা আরও শক্তিশালী করা হোক, যাতে ভবিষ্যতে এ ধরনের ঘটনা প্রতিরোধ করা যায়।৬। মৃত ব্যক্তির পরিবারের সদস্যদের প্রয়োজনীয় মনোসামাজিক সহায়তা, আইনগত সহায়তা এবং প্রযোজ্য ক্ষেত্রে যথাযথ ও কার্যকর আর্থিক ক্ষতিপূরণ প্রদানের ব্যবস্থা করা হোক।৭। মৃত ব্যক্তির পরিবারের সদস্যরা যাতে ভবিষ্যতে কোনো ধরনের হয়রানি, ভয়ভীতি প্রদর্শন, প্রতিশোধমূলক আচরণ বা অন্য কোনো ধরনের চাপের সম্মুখীন না হন, সে জন্য তাঁদের নিরাপত্তা ও সুরক্ষা নিশ্চিত করা হোক।৮। বাংলাদেশে পুলিশ হেফাজতে নির্যাতন ও মৃত্যুর অভিযোগ প্রতিরোধে কার্যকর নীতি গ্রহণ, জবাবদিহিতা বৃদ্ধি এবং আইনশৃঙ্খলা রক্ষাকারী বাহিনীর সদস্যদের আন্তর্জাতিক মানবাধিকার মানদণ্ড ও মানবাধিকারভিত্তিক আইন প্রয়োগ বিষয়ে নিয়মিত প্রশিক্ষণের ব্যবস্থা গ্রহণ করা হোক।
মাননীয় প্রধানমন্ত্রী,
আমরা বিশ্বাস করি যে, আপনার সরকার আইনের শাসন প্রতিষ্ঠা, মানবাধিকার সুরক্ষা এবং বিচার বিভাগের প্রতি জনগণের আস্থা অটুট রাখতে প্রতিশ্রুতিবদ্ধ। সেই বিশ্বাস থেকেই আমরা আশা করি, পুলিশ হেফাজতে সংঘটিত এই মৃত্যুর ঘটনাটি সর্বোচ্চ গুরুত্বের সঙ্গে বিবেচনা করে একটি স্বাধীন, নিরপেক্ষ ও বিশ্বাসযোগ্য তদন্ত, কার্যকর জবাবদিহিতা এবং দায়ী ব্যক্তিদের বিরুদ্ধে আইনানুগ ব্যবস্থা নিশ্চিত করতে আপনি প্রয়োজনীয় পদক্ষেপ গ্রহণ করবেন।
আমরা আরও আশা করি যে, এ ঘটনার নিরপেক্ষ তদন্তের মাধ্যমে সত্য উদ্ঘাটিত হবে, ভুক্তভোগী পরিবারের ন্যায়বিচার নিশ্চিত হবে এবং ভবিষ্যতে পুলিশ হেফাজতে নির্যাতন ও মৃত্যুর মতো ঘটনার পুনরাবৃত্তি রোধে কার্যকর প্রাতিষ্ঠানিক সংস্কার গ্রহণ করা হবে।
এ বিষয়ে গৃহীত পদক্ষেপের একটি অনুলিপি জেএমবিএফ-এর কার্যালয়ে প্রেরণের জন্য বিনীত অনুরোধ জানাচ্ছি।

Honorable Premier ministre,
Au nom de JusticeMakers Bangladesh in France (JMBF), une organisation internationale de défense des droits humains basée en France et fondée conformément aux principes et aux valeurs de la Charte internationale des droits de l'homme, je vous adresse mes salutations distinguées.
Selon les informations publiées par plusieurs médias nationaux, ainsi que les renseignements obtenus par les sources crédibles de JMBF, M. Asaduzzaman Asad (25 ans) a été arrêté le 18 juillet 2026 par la police de la Branche des détectives (DB) du district de Bogura en tant que suspect dans l'affaire du meurtre d'un conducteur d'auto-rickshaw fonctionnant au GNC. Le matin du 19 juillet 2026, avant même d'être présenté devant un tribunal, il est décédé alors qu'il était détenu dans la cellule de garde des locaux de la DB.
Selon la version de la police de la DB, M. Asad se serait suicidé en se pendant à l'aide d'un lungi attaché à la grille d'aération des toilettes de la cellule. Toutefois, les membres de sa famille affirment qu'il a été soumis à des actes de torture pendant sa détention policière et que son décès est faussement présenté comme un suicide. Ces versions contradictoires démontrent l'urgence de mener une enquête indépendante, impartiale, transparente et crédible afin d'établir les véritables causes et circonstances de son décès et de déterminer les responsabilités éventuelles.
Étant donné que cet incident s'est produit alors que M. Asad se trouvait entièrement sous la garde et le contrôle de l'État, de sérieuses questions se posent quant au respect, par les autorités compétentes, de leur obligation de protéger sa vie et d'assurer sa sécurité ; quant à savoir s'il a été victime de torture ou d'autres traitements ou peines cruels, inhumains ou dégradants ; ainsi que sur l'éventuelle existence de négligences, de fautes professionnelles, d'abus d'autorité ou de manquements aux devoirs des agents responsables de sa détention.
Tout décès survenant en garde à vue constitue une question d'une extrême gravité au regard de la Constitution du Bangladesh, du droit international des droits de l'homme et des obligations internationales du Bangladesh. L'article 6 du Pacte international relatif aux droits civils et politiques (PIDCP) garantit à toute personne le droit inhérent à la vie. De même, la Convention des Nations Unies contre la torture (CAT) ainsi que le Protocole du Minnesota sur les enquêtes relatives aux décès potentiellement illicites (2016) imposent aux États de mener, pour tout décès survenu en détention, une enquête rapide, indépendante, impartiale, efficace, transparente et crédible.
Par ailleurs, la Constitution du Bangladesh garantit à chaque citoyen le droit à la vie, à la liberté individuelle et à une égale protection de la loi. Qu'une personne soit accusée ou simplement suspectée d'une infraction, l'État demeure pleinement responsable de la protection de sa vie et de sa sécurité lorsqu'elle est placée sous sa garde. Dès lors, tout décès en détention soulève des préoccupations fondamentales concernant la justice, la responsabilité des autorités et la confiance du public envers les institutions chargées de l'application de la loi.
À la lumière de ce qui précède, nous exhortons respectueusement votre Gouvernement à :
- Mettre en place une enquête indépendante, judiciaire, impartiale, transparente, rapide et efficace sur le décès de M. Asaduzzaman Asad alors qu'il était détenu par la police de la Branche des détectives (DB) du district de Bogura, avec la participation, l'observation ou l'assistance technique d'experts internationaux en droits humains.
- Veiller à ce que l'enquête soit menée dans le plein respect du Protocole du Minnesota sur les enquêtes relatives aux décès potentiellement illicites (2016) et que toutes les preuves pertinentes — notamment les enregistrements de vidéosurveillance (CCTV), les registres de détention, les tableaux de service, les dossiers médicaux, les preuves médico-légales, les rapports d'autopsie, les déclarations des témoins ainsi que tout autre élément utile — soient immédiatement préservées, sécurisées et examinées.
- Si l'enquête révèle des éléments de négligence, de torture, d'abus d'autorité ou toute autre conduite illégale imputable à des policiers ou à toute autre personne, veiller à ce que les responsables soient poursuivis conformément à la loi et traduits devant une juridiction indépendante, impartiale et transparente, avec l'application de sanctions appropriées en cas de condamnation.
- Garantir que la famille du défunt soit régulièrement informée de l'évolution de l'enquête, bénéficie d'une assistance juridique appropriée et dispose d'un accès plein et effectif à la justice.
- Renforcer les mesures de sécurité, les services de santé, les systèmes efficaces de vidéosurveillance (CCTV), les mécanismes indépendants d'inspection et de contrôle ainsi que les garanties applicables à toutes les personnes détenues dans les postes de police, les bureaux de la Branche des détectives (DB) et tous les autres lieux de détention au Bangladesh, conformément aux normes internationales relatives aux droits humains, afin de prévenir la répétition de tels incidents.
- Fournir à la famille du défunt un soutien psychosocial approprié, une assistance juridique et, le cas échéant, une indemnisation adéquate, effective et rapide, conformément à la loi et aux normes internationales relatives aux droits humains.
- Assurer la sécurité et la protection des membres de la famille du défunt, de leurs représentants légaux, des témoins et de toute autre personne coopérant avec l'enquête, afin qu'ils ne fassent l'objet d'aucune intimidation, menace, représaille, harcèlement ou autre forme de pression liée à cette affaire.
- Adopter des mesures législatives, administratives et institutionnelles efficaces afin de prévenir la torture et les décès en garde à vue, de renforcer les mécanismes de responsabilité, de garantir des enquêtes rapides sur toutes les allégations de mauvais traitements en détention et de dispenser régulièrement aux forces de l'ordre des formations fondées sur les droits humains, conformément aux obligations internationales du Bangladesh.
Honorable Premier ministre,
Nous sommes convaincus que votre Gouvernement demeure attaché au respect de l'État de droit, à la protection des droits humains et au maintien de la confiance du public dans l'administration de la justice. C'est dans cet esprit que nous vous demandons respectueusement d'accorder à ce décès survenu en détention toute l'attention qu'il mérite, en veillant à ce qu'une enquête indépendante, impartiale, transparente et crédible soit menée, que les responsabilités soient effectivement établies et que les mesures judiciaires appropriées soient prises à l'encontre de toute personne reconnue responsable.
Nous espérons en outre qu'une enquête transparente permettra d'établir la vérité, de rendre justice à la famille de la victime et de contribuer à des réformes institutionnelles significatives destinées à prévenir de futurs actes de torture et décès en garde à vue.
