JMBF firmly believes that these incidents constitute a clear violation of the fundamental human rights enshrined in the Constitution of Bangladesh and the Universal Declaration of Human Rights of the United Nations, and amount to a direct assault on the democratic process. At the same time, JMBF calls for the immediate formation of an international-standard investigation committee under the overall supervision of the United Nations Special Rapporteur on the Independence of Judges and Lawyers.
According to reports published in various newspapers and verified information received from JMBF’s own reliable sources, lawyers of a particular political ideology were deprived of the opportunity to collect and submit nomination papers in the Dhaka District Bar Association, one of the country’s largest bar organizations. Likewise, in Shariatpur, an uncontested election was held amid allegations of obstruction and harassment during the submission of nomination papers. In Chandpur, Dinajpur, and Naogaon, elections were organized without providing Awami League-aligned lawyers with the opportunity to participate, indicating a systematic and deliberate pattern of democratic exclusion.
JMBF believes that bar associations are not merely professional bodies; they are institutions that uphold justice, the rule of law, and democratic values. If equal opportunity for participation, freedom of expression, and the right to contest are not ensured, it poses a threat not only to the concerned associations but also to the country’s entire judicial system and democratic framework.
Articles 27, 37, and 38 of the Constitution of Bangladesh guarantee citizens equality before the law, freedom of assembly, and freedom of association. Furthermore, international human rights instruments—particularly Articles 20 and 21 of the Universal Declaration of Human Rights (UDHR) and Articles 22 and 25 of the International Covenant on Civil and Political Rights (ICCPR)—recognize every citizen’s right to free participation, association, and contestation in elections. By violating these fundamental rights, the elections in question have also deviated from international standards.
JMBF wishes to state clearly that being elected “unopposed” carries legitimacy only when equal opportunity is ensured for all potential candidates. However, the elections organized here—by obstructing competition, suppressing dissenting views, and preventing candidacies—are not democratic in any real sense; rather, they amount to a controlled and farcical process.
Demands of JusticeMakers Bangladesh in France (JMBF):
- Ensure a neutral and judicial investigation into electoral irregularities, obstruction, and violence in all concerned bar associations.
- Ensure that elections that were not participatory are annulled and that fresh elections are organized in a free, fair, and inclusive manner.
- Ensure that lawyers’ constitutional rights to submit nomination papers and participate in elections are fully guaranteed.
- Ensure equal opportunity and security for all parties involved in the election process.
- Ensure the restoration of the democratic structure of professional bodies in line with international standards.
JMBF strongly calls upon the United Nations, international human rights organizations, bar councils, and global institutions working to uphold the rule of law to pay close attention to the situation in Bangladesh’s bar associations and to take necessary measures.
Lawyers are frontline defenders in the struggle to establish the rule of law and justice. Silencing their voices means obstructing the path to justice. JMBF strongly condemns these unjust and undemocratic acts and demands their immediate cessation.

Brief Description of the Incidents: (Based on reports published in various newspapers and verified information received from JMFB’s own reliable sources)
Incident No. 01: Obstruction to the Participation of Bangladesh Awami League-Aligned and Independent Lawyers in the Election of the Dhaka District Bar Association
In the 2026–2027 election of the Dhaka District Bar Association, the largest bar association in Asia, the participation of leaders, activists, supporters, and independent members aligned with Bangladesh’s largest political party, the Bangladesh Awami League, was obstructed. Although voting is scheduled to be held on 29 and 30 April, Awami League leaders, activists, supporters, and independent candidates were not allowed to submit their nomination papers.
Ignoring the association’s constitution, the electoral process is being conducted with extreme secrecy and arbitrariness. According to general lawyers, no ordinary member or independent candidate outside the influence of the current ad hoc committee was even allowed to collect a nomination form. Essentially, this “form syndicate” has been created to ensure that no one other than candidates nominated by the BNP, Jamaat, and NCP can contest the election.
Since the political changeover on 5 August 2024, there has been no elected committee in the Dhaka Bar for a prolonged period of 20 months. BNP-Jamaat-aligned lawyers formed a convening committee and have kept this large institution under their control. Instead of holding elections in accordance with democratic norms, the current convening committee is planning to install its loyalists in power through “unopposed” or merely nominal elections.
Incident No. 02: Obstruction in Submission of Nominations in the Shariatpur District Bar Association Election
Amid allegations of obstruction and harassment surrounding the submission of nomination papers in the Shariatpur District Bar Association election, candidates of the BNP-aligned Jatiyatabadi Ainjibi Forum were ultimately declared elected without contest.
On Monday, 13 April, after the submission and scrutiny of nomination papers, the relevant election commission announced that since there were no other candidates for the designated posts, the candidates of the BNP-aligned panel were declared elected unopposed.
Sources from the district bar association state that the election schedule was announced on 2 April, and voting was set for 25 April. Sunday was fixed as the day for collecting and submitting nomination papers.
Eyewitness lawyers reported that from 11:00 a.m. to 2:00 p.m. on Sunday, 12 April, nomination papers were scheduled to be sold and submitted in the hall room on the ground floor of the bar association building. However, during this time, members of the Jatiyatabadi Ainjibi Forum and outsiders blocked the entrance to the election office and prevented candidates of other panels from collecting nomination papers. Some candidates were even physically harassed.
Incident No. 03: Election Held in Chandpur District Bar Association Without Providing Awami League-Aligned Lawyers the Opportunity to Participate
Without providing Bangladesh Awami League-aligned lawyers with the opportunity to participate, and with no competing panel, the BNP-supported Somomona Ainjibi Oikya Panel was declared elected unopposed in the Chandpur District Bar Association election.
On Thursday afternoon, 5 March, Chief Election Commissioner Advocate Babar Bepari announced the names of the elected panel at the district bar association auditorium.
Leaders, activists, and supporter lawyers of the Bangladesh Awami League were not given the opportunity to participate in the election.
On 26 February, two panels supported by the BNP and Jamaat submitted nomination papers. The election was scheduled for 5 March. However, on 1 March, citing the lack of a fair electoral environment, the Jamaat-supported Oikyoboddho Ainjibi Kallyan Parishad withdrew its full panel of nominations before the Chief Election Commissioner.
Incident No. 04: Election Held in Dinajpur Bar Association Without Providing Awami League-Aligned Lawyers the Opportunity to Participate
Without the participation of Bangladesh Awami League-aligned lawyers, the BNP-supported Jatiyatabadi Ainjibi Forum won the majority of posts in the Dinajpur District Bar Association election held on Saturday, 11 April.
As in the previous year, this year too, leaders, activists, and supporter lawyers of the Bangladesh Awami League were denied the opportunity to participate in the election after being labeled as “associates of the previous government.”

এই সকল ঘটনা বাংলাদেশ সংবিধান ও জাতিসংঘের সার্বজনীন মানবাধিকার ঘোষণাপত্রে বর্ণিত মৌলিক মানবাধিকারের সুস্পষ্ট লঙ্ঘন এবং গণতান্ত্রিক প্রক্রিয়ার প্রতি সরাসরি আঘাত বলে জেএমবিএফ দৃঢ়ভাবে বিশ্বাস করে। পাশাপাশি জেএমবিএফ অবিলম্বে জাতিসংঘের আইনজীবী ও বিচারকদের স্বাধীনতা বিষয়ক বিশেষ দূতের সার্বিক তত্ত্বাবধানে একটি আন্তর্জাতিক মানের তদন্ত কমিটি গঠনের আহ্বান জানাচ্ছে।
বিভিন্ন পত্রিকায় প্রকাশিত খবর এবং জেএমবিএফ-এর নিজস্ব নির্ভরযোগ্য সূত্রে প্রাপ্ত তথ্যে জানা যায় যে, ঢাকা জেলা আইনজীবী সমিতির মতো দেশের অন্যতম বৃহৎ আইনজীবী সংগঠনে মনোনয়নপত্র সংগ্রহ ও দাখিলের সুযোগ থেকে নির্দিষ্ট একটি রাজনৈতিক মতাদর্শের আইনজীবীদের বঞ্চিত করা হয়েছে। একইভাবে শরীয়তপুরে মনোনয়ন দাখিলে বাধা ও লাঞ্ছনার অভিযোগের প্রেক্ষিতে প্রতিদ্বন্দ্বিতাহীন নির্বাচন অনুষ্ঠিত হয়েছে। চাঁদপুর, দিনাজপুর ও নওগাঁতে আওয়ামী লীগপন্থী আইনজীবীদের অংশগ্রহণের সুযোগ প্রদান ছাড়া নির্বাচন আয়োজন একটি সুসংগঠিত ও পরিকল্পিত গণতান্ত্রিক বর্জনের ইঙ্গিত বহন করে।
জেএমবিএফ মনে করে, আইনজীবী সমিতিগুলো কেবল পেশাজীবী সংগঠন নয়; এগুলো ন্যায়বিচার, আইনের শাসন ও গণতান্ত্রিক মূল্যবোধের ধারক ও বাহক। সেখানে যদি অংশগ্রহণের সমান সুযোগ, মতপ্রকাশের স্বাধীনতা এবং প্রতিদ্বন্দ্বিতার অধিকার নিশ্চিত না হয়, তবে তা শুধু সংশ্লিষ্ট সমিতির জন্য নয়, বরং গোটা বিচারব্যবস্থা ও রাষ্ট্রের গণতান্ত্রিক কাঠামোর জন্য হুমকিস্বরূপ।
বাংলাদেশের সংবিধানের ২৭, ৩৭ ও ৩৮ অনুচ্ছেদে নাগরিকদের সমঅধিকার, সমাবেশ ও সংগঠন করার স্বাধীনতা নিশ্চিত করা হয়েছে। তদুপরি, আন্তর্জাতিক মানবাধিকার সনদসমূহ—বিশেষ করে Universal Declaration of Human Rights (UDHR)-এর ২০ ও ২১ অনুচ্ছেদ এবং International Covenant on Civil and Political Rights (ICCPR)-এর ২২ ও ২৫ অনুচ্ছেদ—প্রত্যেক নাগরিকের অবাধ অংশগ্রহণ, সংগঠন গঠন এবং নির্বাচনে অংশগ্রহণের অধিকারকে স্বীকৃতি দেয়। এসব মৌলিক অধিকার লঙ্ঘনের মাধ্যমে সংশ্লিষ্ট নির্বাচনগুলো আন্তর্জাতিক মানদণ্ড থেকেও বিচ্যুত হয়েছে।
জেএমবিএফ সুস্পষ্টভাবে বলতে চায় যে, “বিনা প্রতিদ্বন্দ্বিতায়” নির্বাচিত হওয়া তখনই বৈধতা পায়, যখন সকল সম্ভাব্য প্রার্থীর জন্য সমান সুযোগ নিশ্চিত থাকে। কিন্তু এখানে প্রতিদ্বন্দ্বিতা প্রতিহত করে, বিরোধী মতকে দমন করে এবং প্রার্থিতা বাধাগ্রস্ত করে যে নির্বাচন আয়োজন করা হয়েছে, তা প্রকৃত অর্থে গণতান্ত্রিক নয়—বরং এটি একটি নিয়ন্ত্রিত ও প্রহসনমূলক প্রক্রিয়া।
জাস্টিসমেকার্স বাংলাদেশ ইন ফ্রান্স (জেএমবিএফ)-এর দাবিসমূহঃ
১. সংশ্লিষ্ট সকল আইনজীবী সমিতির নির্বাচনী অনিয়ম, বাধা ও সহিংসতার ঘটনার নিরপেক্ষ ও বিচারিক তদন্ত নিশ্চিত করতে হবে।২. যেসব নির্বাচন অংশগ্রহণমূলক ছিল না, সেগুলো বাতিল করে অবাধ, সুষ্ঠু ও অন্তর্ভুক্তিমূলক নির্বাচন পুনরায় আয়োজন করতে হবে।৩. আইনজীবীদের মনোনয়নপত্র দাখিল ও নির্বাচনে অংশগ্রহণের সাংবিধানিক অধিকার নিশ্চিত করতে হবে।৪. নির্বাচন প্রক্রিয়ায় জড়িত সকল পক্ষের জন্য সমান সুযোগ ও নিরাপত্তা নিশ্চিত করতে হবে।৫. আন্তর্জাতিক মানদণ্ড অনুযায়ী পেশাজীবী সংগঠনগুলোর গণতান্ত্রিক কাঠামো পুনঃপ্রতিষ্ঠা করতে হবে।
জেএমবিএফ জাতিসংঘ, আন্তর্জাতিক মানবাধিকার সংস্থা, বার কাউন্সিলসমূহ এবং আইনের শাসন প্রতিষ্ঠায় কাজ করা বৈশ্বিক প্রতিষ্ঠানগুলোর প্রতি বাংলাদেশের আইনজীবী সমিতিগুলোর এই পরিস্থিতির প্রতি দৃষ্টি দেওয়ার জন্য এবং প্রয়োজনীয় পদক্ষেপ গ্রহণের জন্য দৃঢ় আহ্বান জানাচ্ছে।
আইনের শাসন ও ন্যায়বিচার প্রতিষ্ঠার লড়াইয়ে আইনজীবীরা সামনের সারির যোদ্ধা। তাদের কণ্ঠ রুদ্ধ করা মানে ন্যায়বিচারের পথ রুদ্ধ করা। জেএমবিএফ এই অন্যায় ও অগণতান্ত্রিক কর্মকাণ্ডের তীব্র নিন্দা জানাচ্ছে এবং অবিলম্বে এর অবসান দাবি করছে।

এশিয়ার বৃহত্তম আইনজীবী সমিতি ঢাকা জেলা আইনজীবী সমিতির ২০২৬-২০২৭ মেয়াদের নির্বাচনে বাংলাদেশের বৃহত্তম রাজনৈতিক দল বাংলাদেশ আওয়ামী লীগের নেতা, কর্মী, সমর্থক এবং নির্দলীয় সদস্যদের অংশগ্রহণে বাধা প্রদান করা হয়েছে। আগামী ২৯ ও ৩০ এপ্রিল ভোট অনুষ্ঠিত হওয়ার কথা থাকলেও বাংলাদেশ আওয়ামী লীগের নেতা, কর্মী, সমর্থক এবং নির্দলীয় স্বতন্ত্র প্রার্থীদের মনোনয়নপত্র জমা দিতে দেওয়া হয়নি।
সমিতির গঠনতন্ত্র তোয়াক্কা না করে অত্যন্ত গোপনীয়তা ও স্বেচ্ছাচারিতার মাধ্যমে নির্বাচনী কার্যক্রম পরিচালনা করা হচ্ছে। সাধারণ আইনজীবীদের দাবি, বর্তমান অ্যাডহক কমিটির প্রভাব বলয়ের বাইরে থাকা কোনো সাধারণ সদস্য বা স্বতন্ত্র প্রার্থীকে মনোনয়ন ফরমই সংগ্রহ করতে দেওয়া হয়নি। মূলত বিএনপি, জামায়াত ও এনসিপি-র মনোনীত প্রার্থীরা ছাড়া আর কেউ যাতে নির্বাচনে প্রতিদ্বন্দ্বিতা করতে না পারে, সেজন্যই এই ‘ফরম সিন্ডিকেট’ গড়ে তোলা হয়েছে।
৫ আগস্ট ২০২৪ সালে রাজনৈতিক পটপরিবর্তনের পর থেকে দীর্ঘ ২০ মাস ধরে ঢাকা বারে কোনো নির্বাচিত কমিটি নেই। বিএনপি-জামায়াতপন্থী আইনজীবীরা একটি আহ্বায়ক কমিটি করে এই বৃহৎ প্রতিষ্ঠানটি নিজেদের নিয়ন্ত্রণে রেখেছে। গণতান্ত্রিক রীতি মেনে নির্বাচন দেওয়ার পরিবর্তে বর্তমান আহ্বায়ক কমিটি তাদের অনুগত ব্যক্তিদের ‘বিনা প্রতিদ্বন্দ্বিতায়’ বা ‘নামকাওয়াস্তে’ নির্বাচনের মাধ্যমে ক্ষমতায় বসানোর পরিকল্পনা করেছে।
ঘটনা নং ০২ঃ শরীয়তপুর জেলা আইনজীবী সমিতি নির্বাচনে মনোনয়ন দাখিলে বাধা
শরীয়তপুর জেলা আইনজীবী সমিতির নির্বাচনে মনোনয়নপত্র দাখিলকে ঘিরে বাধা ও লাঞ্ছনার অভিযোগের মধ্যে শেষ পর্যন্ত প্রতিদ্বন্দ্বিতা ছাড়াই জয়ী হয়েছেন বিএনপিপন্থী জাতীয়তাবাদী আইনজীবী ফোরামের প্রার্থীরা।
১৩ এপ্রিল, সোমবার মনোনয়নপত্র দাখিল ও যাচাই-বাছাই শেষে সংশ্লিষ্ট নির্বাচন কমিশন জানায়, নির্ধারিত পদগুলোর বিপরীতে অন্য কোনো প্রার্থী না থাকায় বিএনপিপন্থী প্যানেলের প্রার্থীদের বিনা প্রতিদ্বন্দ্বিতায় বিজয়ী ঘোষণা করা হয়েছে।
জেলা আইনজীবী সমিতি সূত্রে জানা যায়, ২ এপ্রিল তফসিল ঘোষণা করে আইনজীবী সমিতির নির্ধারিত নির্বাচন কমিশন। ২৫ এপ্রিল ভোট গ্রহণের দিন নির্ধারিত ছিল। রোববার প্রার্থীদের মনোনয়নপত্র সংগ্রহ ও দাখিলের দিন নির্ধারণ করা হয়।
প্রত্যক্ষদর্শী আইনজীবীরা জানান, ১২ এপ্রিল, রোববার সকাল ১১টা থেকে দুপুর ২টা পর্যন্ত আইনজীবী সমিতি ভবনের নিচতলার হলরুমে মনোনয়নপত্র কেনা ও জমা দেওয়ার সময় নির্ধারিত ছিল। কিন্তু এ সময় জাতীয়তাবাদী আইনজীবী ফোরামের কিছু সদস্য ও বহিরাগতরা নির্বাচন কার্যালয়ের প্রবেশপথে অবস্থান নিয়ে অন্য প্যানেলের প্রার্থীদের মনোনয়নপত্র সংগ্রহে বাধা দেন। এমনকি কয়েকজন প্রার্থীকে শারীরিকভাবে লাঞ্ছিত করার ঘটনাও ঘটে।
ঘটনা নং ০৩ঃ চাঁদপুর জেলা আইনজীবী সমিতি নির্বাচনে আওয়ামীপন্থী আইনজীবীদের অংশগ্রহণের সুযোগ প্রদান ছাড়াই নির্বাচন অনুষ্ঠিত
প্রতিদ্বন্দ্বী বাংলাদেশ আওয়ামী লীগপন্থী আইনজীবীদের অংশগ্রহণের সুযোগ প্রদান ছাড়াই কোনো প্রতিদ্বন্দ্বী প্যানেল না থাকায় চাঁদপুর জেলা আইনজীবী সমিতি নির্বাচনে বিনা প্রতিদ্বন্দ্বিতায় নির্বাচিত হয়েছেন বিএনপি সমর্থিত সমমনা আইনজীবী ঐক্য প্যানেল। ৫ মার্চ, বৃহস্পতিবার দুপুরে জেলা আইনজীবী সমিতি মিলনায়তনে নির্বাচিত প্যানেলের নাম ঘোষণা করেন প্রধান নির্বাচন কমিশনার অ্যাডভোকেট বাবর বেপারী।
নির্বাচনে বাংলাদেশের বৃহত্তম রাজনৈতিক দল বাংলাদেশ আওয়ামী লীগের নেতা, কর্মী ও সমর্থক আইনজীবীদের অংশগ্রহণের সুযোগ প্রদান করা হয়নি।
গত ২৬ ফেব্রুয়ারি বিএনপি ও জামায়াত সমর্থিত দুটি প্যানেল মনোনয়নপত্র দাখিল করে। ৫ মার্চ ছিল নির্বাচনের নির্ধারিত তারিখ। কিন্তু গত ১ মার্চ নির্বাচনে সুষ্ঠু পরিবেশ নেই—এমন অভিযোগ এনে প্রধান নির্বাচন কমিশনারের নিকট পূর্ণ প্যানেলে মনোনয়নপত্র প্রত্যাহার করে জামায়াত সমর্থিত ঐক্যবদ্ধ আইনজীবী কল্যাণ পরিষদ।
ঘটনা নং ০৪ঃ দিনাজপুর আইনজীবী সমিতি নির্বাচনে বাংলাদেশ আওয়ামী লীগপন্থী আইনজীবীদের অংশগ্রহণের সুযোগ প্রদান ছাড়াই নির্বাচন অনুষ্ঠিত
দেশের বৃহত্তম রাজনৈতিক দল বাংলাদেশ আওয়ামী লীগপন্থী আইনজীবীদের অংশগ্রহণ ছাড়াই গত ১১ এপ্রিল, শনিবার দিনাজপুর জেলা আইনজীবী সমিতির নির্বাচনে সংখ্যাগরিষ্ঠ পদে জয় পেয়েছে বিএনপি সমর্থিত জাতীয়তাবাদী আইনজীবী ফোরাম। নির্বাচনে গত বছরের ন্যায় এবছরও বাংলাদেশের বৃহত্তম রাজনৈতিক দল বাংলাদেশ আওয়ামী লীগের নেতা, কর্মী ও সমর্থক আইনজীবীদের ‘বিগত সরকারের দোসর’ আখ্যা দিয়ে নির্বাচনে অংশগ্রহণের সুযোগ প্রদান করা হয়নি।

দেশের বৃহত্তম রাজনৈতিক দল বাংলাদেশ আওয়ামী লীগপন্থী আইনজীবীদের অংশগ্রহণ ছাড়াই গত ২ মার্চ, সোমবার নওগাঁ জেলা আইনজীবী সমিতির নির্বাচনে সংখ্যাগরিষ্ঠ পদে জয় পেয়েছে বিএনপি সমর্থিত জাতীয়তাবাদী আইনজীবী ফোরাম। নির্বাচনে গত বছরের ন্যায় এবছরও বাংলাদেশের বৃহত্তম রাজনৈতিক দল বাংলাদেশ আওয়ামী লীগের নেতা, কর্মী ও সমর্থক আইনজীবীদের ‘বিগত সরকারের দোসর’ আখ্যা দিয়ে নির্বাচনে অংশগ্রহণের সুযোগ প্রদান করা হয়নি।
ALERTE BANGLADESH : JMBF profondément préoccupée par l’obstruction à la participation des avocats pro-Awami League aux élections des barreaux
Paris, France | 15 avril 2026 : JusticeMakers Bangladesh in France (JMBF) exprime sa profonde inquiétude, sa vive condamnation et sa protestation face aux graves allégations concernant les récentes élections des associations du barreau à Dhaka, Shariatpur, Chandpur, Dinajpur et Naogaon, où des avocats proches de la Bangladesh Awami League ainsi que des candidats indépendants ont été empêchés de participer, empêchés de déposer leurs candidatures et, dans certains cas, ont même été victimes de violences physiques uniquement en raison de leur orientation politique.
JMBF estime fermement que ces incidents constituent une violation manifeste des droits fondamentaux garantis par la Constitution du Bangladesh et la Déclaration universelle des droits de l’homme des Nations Unies, et qu’ils représentent une atteinte directe au processus démocratique. Par ailleurs, JMBF appelle à la mise en place immédiate d’une commission d’enquête conforme aux standards internationaux, sous la supervision du Rapporteur spécial des Nations Unies sur l’indépendance des juges et des avocats.
Selon des informations publiées dans différents journaux ainsi que des données vérifiées provenant de sources fiables propres à JMBF, des avocats appartenant à une certaine orientation politique ont été privés de la possibilité de retirer et de déposer des formulaires de candidature au sein du Barreau du district de Dhaka, l’une des plus grandes associations du barreau du pays. De même, à Shariatpur, une élection sans opposition a été organisée dans un contexte d’allégations d’obstruction et de harcèlement lors du dépôt des candidatures. À Chandpur, Dinajpur et Naogaon, des élections ont été organisées sans permettre aux avocats proches de la Awami League de participer, ce qui indique un schéma systématique et délibéré d’exclusion démocratique.
JMBF considère que les associations du barreau ne sont pas de simples organisations professionnelles ; elles sont des institutions garantes de la justice, de l’État de droit et des valeurs démocratiques. Si l’égalité des chances en matière de participation, la liberté d’expression et le droit de se présenter aux élections ne sont pas assurés, cela constitue une menace non seulement pour les associations concernées, mais aussi pour l’ensemble du système judiciaire et du cadre démocratique du pays.
Les articles 27, 37 et 38 de la Constitution du Bangladesh garantissent l’égalité devant la loi, la liberté de réunion et la liberté d’association. En outre, les instruments internationaux relatifs aux droits de l’homme — notamment les articles 20 et 21 de la Déclaration universelle des droits de l’homme (DUDH) ainsi que les articles 22 et 25 du Pacte international relatif aux droits civils et politiques (PIDCP) — reconnaissent à chaque citoyen le droit de participer librement, de s’associer et de se présenter aux élections. En violant ces droits fondamentaux, les élections en question s’écartent également des normes internationales.
JMBF tient à souligner clairement que le fait d’être élu « sans opposition » n’est légitime que si l’égalité des chances est garantie à tous les candidats potentiels. Or, les élections organisées dans ces conditions — en entravant la concurrence, en supprimant les opinions dissidentes et en empêchant les candidatures — ne sont en aucun cas démocratiques ; elles constituent plutôt un processus contrôlé et simulé.
Revendications de JusticeMakers Bangladesh in France (JMBF) :
- Assurer une enquête impartiale et judiciaire sur les irrégularités électorales, les obstructions et les violences dans toutes les associations du barreau concernées.
- Assurer l’annulation des élections non participatives et l’organisation de nouvelles élections libres, équitables et inclusives.
- Assurer la garantie pleine et entière des droits constitutionnels des avocats à déposer leur candidature et à participer aux élections.
- Assurer l’égalité des chances et la sécurité pour toutes les parties impliquées dans le processus électoral.
- Assurer le rétablissement de la structure démocratique des organisations professionnelles conformément aux normes internationales.
JMBF appelle fermement les Nations Unies, les organisations internationales de défense des droits de l’homme, les conseils du barreau et les institutions mondiales œuvrant pour l’État de droit à prêter une attention particulière à la situation des associations du barreau au Bangladesh et à prendre les mesures nécessaires.
Les avocats sont en première ligne dans la lutte pour l’établissement de l’État de droit et de la justice. Faire taire leur voix revient à entraver le chemin vers la justice. JMBF condamne fermement ces actes injustes et antidémocratiques et exige leur cessation immédiate.

Brève description des incidents (Basée sur des informations publiées dans différents journaux et vérifiées par les sources fiables de JMBF)
Incident n° 01 : Obstruction à la participation des avocats proches de la Bangladesh Awami League et des candidats indépendants à l’élection du Barreau du district de Dhaka
Lors de l’élection 2026–2027 du Barreau du district de Dhaka, la plus grande association du barreau en Asie, la participation des dirigeants, militants, sympathisants et membres indépendants affiliés à la Bangladesh Awami League a été entravée. Bien que le scrutin soit prévu les 29 et 30 avril, ces derniers n’ont pas été autorisés à déposer leurs candidatures.
Ignorant la constitution de l’association, le processus électoral est mené dans une opacité et un arbitraire extrêmes. Selon des avocats, aucun membre ordinaire ou candidat indépendant en dehors de l’influence du comité ad hoc actuel n’a été autorisé à obtenir un formulaire de candidature. Ce « syndicat des formulaires » a été mis en place afin de garantir que seuls les candidats soutenus par le BNP, Jamaat et NCP puissent se présenter.
Depuis le changement politique du 5 août 2024, aucun comité élu n’a été mis en place au Barreau de Dhaka depuis plus de 20 mois. Des avocats proches du BNP et de Jamaat ont constitué un comité de convocation et contrôlent cette importante institution. Au lieu d’organiser des élections démocratiques, ce comité prévoit d’installer ses partisans par des élections « sans opposition » ou purement formelles.
Incident n° 02 : Obstruction au dépôt des candidatures lors de l’élection du Barreau du district de Shariatpur
Dans un contexte d’allégations d’obstruction et de harcèlement lors du dépôt des candidatures, les candidats du Jatiyatabadi Ainjibi Forum, affilié au BNP, ont finalement été déclarés élus sans opposition.
Le lundi 13 avril, après le dépôt et la vérification des candidatures, la commission électorale a annoncé que, faute de concurrents, les candidats du panel affilié au BNP étaient déclarés élus sans opposition.
Selon des sources du barreau, le calendrier électoral avait été annoncé le 2 avril et le vote était prévu pour le 25 avril. Le dimanche avait été fixé comme journée de retrait et de dépôt des candidatures.
Des avocats témoins ont indiqué que, de 11h00 à 14h00 le dimanche 12 avril, la vente et le dépôt des formulaires de candidature devaient avoir lieu dans la salle située au rez-de-chaussée du bâtiment. Cependant, des membres du Jatiyatabadi Ainjibi Forum et des personnes extérieures ont bloqué l’accès au bureau électoral et empêché les candidats d’autres panels d’obtenir les formulaires. Certains candidats ont même été victimes de violences physiques.
Incident n° 03 : Élection au Barreau de Chandpur sans participation des avocats proches de la Awami League
Sans permettre la participation des avocats proches de la Bangladesh Awami League et en l’absence de panel concurrent, le panel Somomona Ainjibi Oikya, soutenu par le BNP, a été déclaré élu sans opposition.
Le jeudi 5 mars après-midi, le commissaire électoral en chef, Me Babar Bepari, a annoncé les noms des élus au sein de l’auditorium du barreau.
Les avocats affiliés à la Bangladesh Awami League n’ont pas été autorisés à participer à l’élection.
Le 26 février, deux panels soutenus par le BNP et Jamaat avaient déposé leurs candidatures. Le scrutin était prévu pour le 5 mars. Toutefois, le 1er mars, invoquant l’absence de conditions équitables, le panel Jamaat a retiré l’ensemble de ses candidatures.
Incident n° 04 : Élection au Barreau de Dinajpur sans participation des avocats proches de la Awami League
Sans la participation des avocats proches de la Bangladesh Awami League, le Jatiyatabadi Ainjibi Forum soutenu par le BNP a remporté la majorité des postes lors de l’élection tenue le samedi 11 avril.
Comme l’année précédente, les avocats affiliés à la Awami League ont été empêchés de participer, étant qualifiés de « collaborateurs de l’ancien gouvernement ».
Incident n° 05 : Élection au Barreau de Naogaon sans participation des avocats proches de la Awami League
Sans la participation des avocats proches de la Bangladesh Awami League, le Jatiyatabadi Ainjibi Forum soutenu par le BNP a remporté la majorité des postes lors de l’élection tenue le lundi 2 mars.
Comme l’année précédente, les avocats affiliés à la Awami League ont été exclus du processus électoral en étant qualifiés de « collaborateurs de l’ancien gouvernement ».
